Relating to the organization, operation and financing of state government, cancelling or adjusting certain appropriations and transferring certain balances to avoid a deficit ARTICLE 1 SUMMARY Summarizing the reductions in appropriations to certain areas or programs ARTICLE 2 FAMILY AND EARLY CHILDHOOD EDUCATION APPROPRIATION ADJUSTMENTSEliminating the requirement for amounts not needed for Minnesota family investment program social services child care to be used for the basic sliding fee program; reducing certain prior appropriations to the commissioner of children, families and learning for early childhood family education (ECFE) and school age care aids, basic sliding fee, MFIP and transition year child care assistance and child care service grants; increasing a certain prior appropriation from the special revenue fund for basic sliding fee child care assistance; requiring the return of unspent child care balances to the temporary assistance for need families reserve; reducing certain prior appropriations to the commissioner for community education aid and audits, eliminating the position of state adult basic education director; increasing the base level funding for regional library system basic support grants and a certain prior appropriation for regional library telecommunications aid; reducing certain prior appropriations to the commissioner of children, families and learning for referendum tax base replacement, abatement, nonpublic pupil and nonpublic pupil transportation, consolidation transition, charter school building lease and startup cost, integration, magnet school startup, tribal contract school, health and safety, debt service equalization and school lunch aids, for American Indian success for the future and for telecommunication access cost revenue, increasing certain prior appropriations for special education, special education excess cost, travel for home based services, students with disabilities transition programs and alternative facilities bonding aids and adjusting certain prior appropriations for children with a disability aid and fast break to learning grants ARTICLE 5 HIGHER EDUCATION Appropriating money to the higher education services office for state grants and reducing appropriations for certain scholarship programs, for interstate tuition reciprocity, for MnLink, for minitex, for the learning network of Minnesota, for the Minnesota college savings plan and for agency administration, to the board of trustees of the Minnesota state colleges and universities (MnSCU) and to the board of regents of the university of Minnesota, requiring a decrease in administrative expenditures before an increase in student tuition; modifying the cost of attendance for public higher education institutions for state grant calculation purposes; authorizing the consideration of two half year advanced placement courses as one full year course and transferring the reporting and notice requirements from HESO to the commissioner of children, families and learning; increasing the penalty and the maximum account balance limit and authorizing self directed investments under the Minnesota college savings plan; repealing the national service scholars program ARTICLE 6 CORRECTIONSReducing appropriations to the board of public defense and to the department of corrections for adult institutions and for juvenile, community and management services including juvenile residential treatment and extended juvenile jurisdiction reimbursement grants, probation services and the remote electronic alcohol monitoring project, eliminating the pretrial bail evaluation reimbursement and the community reentry program and increasing funding for probation services provided to Clearwater county, requiring reimbursement; reducing appropriations to the ombudsman for corrections and to the sentencing guidelines commission; requiring and providing for the commissioner of administration to issue a request for proposals and select a vendor by certain dates to provide housing and chemical dependency treatment for felony level driving while impaired offenders; reducing the penalty for truancy offenses; making permanent the provision requiring the commissioner of corrections to charge counties or other appropriate jurisdictions a certain percentage of the per diem cost of confinement of juveniles at the correctional facility in Red Wing and of juvenile females committed to the commissioner; requiring the involvement of mental health case management services providers in offender predischarge assessment and planning meetings; specifying a certain notice requirement for petitions alleging the need for child protection or services in the form of out of home placement due to truancy, cases not seeking out of home placement to proceed as juvenile petty offenses, restricting entitlement to counsel at public expense to cases seeking out of home placement; imposing a copayment for public defender services, authorizing court waiver of the copayment requirement and prohibiting use of the requirement as a condition of probation; expanding the content requirements for the annual felony level DWI report to the legislature by the commissioner, requiring the commissioner to share preliminary information with the commissioner of administration for DWI offenders housing and chemical dependency treatment services request for proposals issuance purposes; requiring correctional and social services agencies in counties delivering direct case management services to develop policies and practices maximizing collaborative case planning for adult and juvenile offenders diagnosed with serious and persistent mental illness or severe emotional disturbance, specifying certain policies and practices requirements, requiring county reports to the commissioner of corrections by a certain date and a subsequent commissioner statewide report to the legislature, authorizing the sharing of data among correctional and social services agencies for collaborative case planning purposes ARTICLE 7 PUBLIC SAFETY AND TRANSPORTATION AND OTHER AGENCY APPROPRIATIONSReducing appropriations to the commissioner of transportation (DOT) for air transportation services, for transit administration and for railroads and waterway, to the metropolitan council for transportation services, to the commissioner of public safety for emergency management, for the state fire marshal, for alcohol and gambling enforcement, for the crime victims services center, for law enforcement and community grants including elimination of the model policing program mental illness calls, the Camp Ripley weekend camp and violence prevention council grants, for capitol security and for driver and vehicle and administration services, requiring annual transfers from the automobile theft prevention account in the special revenue fund to the general fund and prohibiting the commissioner from reducing the current allocation of federal Byrne grant funds for the youth experiencing alternatives (YEA) Camp Ripley programs; eliminating the office of crime victim ombudsman and transferring duties to the Minnesota center for crime victim services under the commissioner of public safety; authorizing the commissioner of transportation to use a certain amount of money in the greater Minnesota transit fund for transit program administration; increasing the percentage of money allocated to the general fund from the DWI drivers license reinstatement fee and eliminating the allocation to the alcohol impaired driver education account; requiring the state fire marshal to charge a fee for plan reviews involving flammable liquids, motor vehicle fuel dispensing stations or liquefied petroleum gases; requiring deposit of a certain amount of the fee charged to Indian tribal governments and gambling equipment manufacturers and distributors for background checks in the general fund; changing the payment structure for domestic abuse (battered women) shelters from a per diem system to grants, requiring shelter facilities to comply with reporting requirements imposed by the crime victim services center to improve accountability and program outcomes; reducing certain prior appropriations to the commissioner of public safety for law enforcement and community grants and to the board of peace officer standards and training (POST); requiring the commissioners of corrections and public safety to establish a working group of criminal justice professionals to study the criminal justice system for efficiency and effectiveness purposes, encouraging input from the chief justice of the supreme court and the state public defender and requiring a report to the legislature by a certain date; repealing certain provisions relating to shelter facility per diem payments and the office of crime victim ombudsmanARTICLE 8 ENVIRONMENT AND NATURAL RESOURCESReducing appropriations and appropriating money to the pollution control agency, to the office of environmental assistance and to the commissioner of natural resources, providing funding for water and land protection, for mixed municipal solid waste processing payments, for trails and waterways management and for certain Minnesota resources projects including the university of Minnesota film project relating to the history of natural landscapes in the state and the citizens advisory committee to the legislative commission on Minnesota resources (LCMR); reducing appropriations to the zoological board, to the board of water and soil resources and to the science museum of Minnesota, reducing funding for certain grants; requiring the commissioner of finance to transfer a certain amount of money from the Minnesota future resources fund to the general fund; exempting zoological board charges for admission to or use of the Minnesota zoo from the legislative approval requirement; reducing the standing appropriation to the DNR for taconite mining company grants; modifying certain mixed municipal solid waste processing payment provisions, defining processing facility and county, providing for payments to certain additional counties and granting sanitary districts the authority of counties for payments purposes; requiring the PCA to increase fees for water quality permits; repealing BOWSR local water resources protection and management grants program rules and priorities requirements and the requirement to coordinate groundwater education activities with local government units and the DNR and BOWSR annual wetlands report to the legislature ARTICLE 9 AGRICULTURE AND RURAL DEVELOPMENTReducing appropriations to the commissioner of agriculture, to the horticulture society and to the agricultural utilization research institute; cancelling a certain prior appropriation to the commissioner of agriculture for grants to cooperative associations to facilitate the production and marketing of short rotation woody crops to the general fund and requiring the commissioner to transfer certain amounts from the ethanol development fund and the family farm security account to the general or debt service funds; clarifying certain language relating to balances in and transfers to the agricultural and environmental revolving accounts under the agriculture best management practices loan program; reducing ethanol producer payments and limits; repealing the disaster recovery loan program revolving fund and transferring the balance in the fund to the farm manure digester technology revolving loan account ARTICLE 10 STATE GOVERNMENT APPROPRIATIONSReducing appropriations to the legislature, to the constitutional officers, to the board of government innovation and cooperation, to the office of strategic and long range planning, to the departments of administration, finance, employee relations (DOER), revenue and military and veterans affairs, to the amateur sports, humanities and racing commissions, to the arts, campaign finance and public disclosure, investment, capitol area architectural and planning (CAAPB) and lawful gambling control boards, to the Minnesota state retirement system, to the contingent accounts and for the payment of tort claims; specifying legislative intent relating to the distribution of reductions; requiring the payment of warrants over a certain amount through electronic fund transfers; requiring the crediting of receipts from building official services and from building code violation penalties to the special revenue fund in lieu of the general fund; transferring a certain consultation requirement relating to volunteer programs for retired senior citizens from the office of citizenship and volunteer services to the commissioner of human services; requiring judges and survivors receiving benefits from the judges retirement fund to receive the benefits from the postretirement investment fund, requiring the transfer of reserves for judges not receiving benefits from the fund to the postretirement investment fund to pay future benefits by a certain date; requiring the commissioner of finance to redirect repayments from a certain prior loan to the city of St. Paul for the RiverCentre arena from the youth activities account in the special revenue fund to the general fund; requiring the governor to reduce planned executive branch agency general fund expenditures on professional or technical services contracts by a certain amount and placing a moratorium on entering into or renewing the contracts; imposing a state hiring freeze, excepting work study and essential positions and specifying the anticipated savings; repealing the office of citizenship and volunteer services, the board of government innovation and cooperation and an appropriation from the general fund to MSRS for payment of retirement benefits to judges not participating the postretirement fund ARTICLE 11 COURTSReducing appropriations to the supreme court, the court of appeals and the district courts; increasing the district court filing fee for civil actions and the conciliation court filing fee ARTICLE 12 ECONOMIC DEVELOPMENTReducing appropriations to the department of trade and economic development for business and community development, for the Minnesota trade office, for the office of tourism, for information and analysis and for administrative support, to Minnesota Technology, Inc., to the department of economic security for workforce services, to the housing finance agency (HFA), to the departments of commerce and labor and industry, to the bureau of mediation services and to the Minnesota historical society for education and outreach and for preservation and access; realizing certain savings from the state employee strike; reducing the base funding for certain agencies; prohibiting the office of tourism from reducing a certain grant to the Mississippi River parkway commission; requiring the commissioner of finance to transfer a certain amount from the general fund to the workforce development fund for the dislocated worker program; cancelling a certain prior appropriation to DTED for the biomedical innovation and commercialization initiative to the general fund; authorizing the commissioner of economic security to exempt certain programs from reduction to comply with federal regulations relating to maintenance of effort and prohibiting a reduction in the base funding for the displaced homemakers program; cancelling a certain prior appropriation to the office of tourism for the journey travel information system to the general fund and requiring the transfer of certain amounts from the rural policy development center and real estate education, research and recovery funds and from the special revenue accounts of the world trade conference center in the trade office to the general fund; reducing the fees for initial and renewal real estate licenses for payment to the real estate education, research and recovery fund; requiring the transfer of certain excesses in the economic security contingent account to the general fund; delaying the abolishment of the department of economic security and suspending the corresponding reorganization powers of the commissioner of administration ARTICLE 13 CANCELLATIONS, TRANSFERS AND ADJUSTMENTSEliminating the requirement to include inflation adjustments in future forecasts; cancelling the unobligated balances in the budget reserve, local government aid reform, tax relief and cash flow accounts to the general fund, authorizing the commissioner of finance to begin restoring the balance in the cash flow account after a certain date; setting the budget reserve account balance and providing for replenishment under certain general fund balance conditions; authorizing the commissioner to use cash reserves of the tobacco use prevention and local public health endowment fund to pay expenses of the general fund under certain general fund insufficiency determination conditions, specifying certain cash flow transfer return requirements; cancelling certain appropriations for the tax increment financing (TIF) grant account; requiring the commissioner to transfer certain amounts of assets of the assigned risk plan and the special compensation fund to the general fund and appropriating money to the commissioner from the general fund for settlement of a certain lawsuit, repealing a certain provision prohibiting the transfer of assets in the excess surplus account of the special compensation fund before a certain date; reducing a certain prior appropriation to the metropolitan council for a bus transitway; repealing the local government aid reform account ARTICLE 14 - CONTINUING CARE AND LONG TERM CAREModifying certain local needs planning requirements for intermediate care facilities for persons with mental retardation; requiring counties to provide documentation supporting payment rate adjustment requests; requiring the statewide advisory committee for local system needs planning to establish guidelines for ICF MR rate adjustments and state policy directions for providing services to persons with developmental disabilities, eliminating the time limit for committee submittal of recommendations to the commissioner of human services; modifying the requirement for the commissioner to notify counties and providers of the opportunity to submit requests for ICF MR payment rate adjustments; increasing the nursing home license surcharge, limit; requiring the commissioner to authorize the spending of new diversion resources and to manage the reassignment of waiver resources occurring from persons leaving the waiver to reduce costs; increasing the state share of the costs of certain nursing facility placements of persons with disabilities under a certain age; modifying the division of cost between the state and county for certain longer term nursing facility placements of certain persons with disabilities under medical assistance (MA) and increasing the per bed intergovernmental transfer collected from certain counties owning and operating nursing homes for the nonfederal share of medical assistance costs, authorizing commissioner reduction of the transfers under certain payment rate determination conditions; increasing county nursing facility payment rate adjustments, authorizing commissioner reduction to conform to medicare upper payment limits; requiring the commissioner to increase nursing facility case mix payment rates equal to the surcharge increase; modifying the frequency requirement for addenda to county community based services plans and imposing a time limit for area agencies on aging and seniors agenda for independent living (SAIL) projects to provide the commissioner and counties with review and analyses; reducing the frequency requirement for the report to the legislature by the commissioners of health and human services relating to the development of community based services; delaying the deadline for development and implementation of a quality profile system for long term care providers; modifying the criteria and procedures for the provision of variable rate adjustments for ICF MRs; requiring commissioner of human services adjustment of facility total payment rates with recommendations from the host county and the statewide advisory committee; limiting funds available for facility base rate adjustments; modifying a certain provision providing for temporary rate adjustments for ICF MRs to address occupancy and access and certain facility occupancy data maintenance and reporting requirements; delaying the deadline for commissioner development and reporting of a new nursing facility reimbursement system; repealing the requirement for reduction or elimination of the waiting list for home and community based services for persons with mental retardation or related conditions ARTICLE 15 - HEALTH CAREProviding for the payment of university of Minnesota academic health center and clinical graduate medical education costs from medical education and research funds; granting the commissioner of human services the authority to administer a supplemental drug rebate program for drugs purchased under the medical assistance (MA) and prescription drug programs, authorizing contracts with pharmaceutical manufacturers and implementation of prior authorization requirements for drugs from manufacturers not under contract; reducing the medical assistance and general assistance medical care payment rates for fee for service hospital inpatient admissions and outpatient services; modifying the exclusion of assets designated as burial expenses for medical assistance eligibility purposes; clarifying certain provisions providing for the division of assets between spouses in institutionalized spouse cases and expanding the provisions to prohibited transfers, limiting the total amount of assets available to the community spouse, assets exceeding the limit to be considered available to the institutionalized spouse; prohibiting the transfer of certain annuities purchased after a certain date and reducing the dollar limit on uncompensated transfers for period of ineligibility determination purposes; authorizing the commissioner to request prior authorization for medical assistance coverage of drugs based on the cost of the drug; requiring the commissioner to withhold a certain percentage of managed care plan payments for the prepaid medical assistance and GAMC programs and MinnesotaCare pending completion of performance targets, authorizing the commissioner to exclude special demonstration projects involving alternative integrated long term care services for the elderly and disabled; reducing the capitation rates for nonmetropolitan counties for prospective reimbursement rates determination purposes; increasing the funding of the medical education and research fund from capitation rates and increasing the rates; reducing the payment rate for managed care plans under the prepayment demonstration project for covered services after a certain date, exclusions; delaying implementation of the medical assistance outpatient hospital payment system based on the medicare outpatient prospective payment system; expanding MinnesotaCare program eligibility for children; delaying the increase in the income limit for elderly persons enrolled in the prescription drug program; repealing a certain copayment requirement for children under the MinnesotaCare program ARTICLE 16 MISCELLANEOUSEliminating the requirement for the commissioner of health to develop curricula for the training and education of professionals relating to fetal alcohol syndrome (FAS); specifying the intent of the legislature relating to continued operation of the Willmar and Fergus Falls regional treatment centers; repealing the occupational respiratory disease information system advisory group, the juvenile assessment centers grant program, congregate housing on site coordination (OSC) services projects, the work first program and the day training and habilitation reimbursement rate pilot projectARTICLE 17 HEALTH AND HUMAN SERVICES APPROPRIATIONS Appropriating money to the commissioner of human services for basic health care, for MinnesotaCare and general assistance medical care (GAMC), medical assistance long term care waivers and home care, group residential housing and economic support grants and for health care policy administration and reducing appropriations for agency management, for medical assistance basic health care grants for families and children and the elderly and disabled and for certain other health care grants, for basic health care management, for state operated services, for continuing care, aging adult service, medical assistance long term care facilities, chemical dependency entitlement, community social services block and Minnesota supplemental aid (MSA) grants, for continuing care management, for administrative reimbursement and pass through and for children's services; prohibiting certain medical assistance demonstration provider payment rate reductions; providing for administration and funding of the prescription drug program; providing a dental access grants carryover; eliminating the community services planning and service development grant; reducing the base level funding for community services development grants and aids; requiring the commissioner to seek federal funding to offset GRH services costs and to reduce the state maintenance of effort expenditure for Minnesota family investment plan (MFIP) cash and food assistance benefits under certain conditions; reducing appropriations to the commissioner of health for family and community health, for access and quality improvement, for health protection and for management and support services; providing for certain one time grant reductions; appropriating money to the health related licensing boards, prohibiting the commissioner of finance from permitting the allotment, encumbrance or expenditure of money appropriated in excess of the anticipated biennial revenues or accumulated surplus from fees collected by the boards;
