"Minnesota Anti-Terrorism Act of 2002" ARTICLE 1 POLICY Creating a temporary homeland security advisory council to advice the department of public safety on issues relating to homeland security, to review and recommend changes to terrorism preparedness and antiterrorism polices and procedures and to ensure coordination of and accountability for state and federal funding of antiterrorism and terrorism preparedness to be cochaired by the commissioners of public safety and health, specifying certain membership, subcommittee and task force and preparedness implementation plan update and reporting requirements; granting Anoka, Benton, Carver, Chisago, Dakota, Dodge, Fillmore, Freeborn, Goodhue, Hennepin, Houston, Isanti, Mower, Olmsted, Ramsey, Rice, Scott, Sherburne, Steele, Wabasha, Washington, Wright and Winona counties temporary authority to issue bonds or notes to finance the cost of designing, constructing and acquiring public safety communication system infrastructure and equipment for use on the statewide shared public safety radio system, providing for treatment of levies to pay principal and interest on bonds or notes issued; modifying the 911 emergency telephone service fee, setting a range, requiring the commissioner of administration with the approval of the commissioner of finance to establish the amount of the fee within the specified limits and to provide advance notice to companies and carriers of the amount to be collected; modifying the definition of the first phase and defining the second phase for public safety radio communication system implementation purposes; granting the metropolitan council certain additional revenue bond issuance authority, authorizing use of the proceeds to reimburse local government units for the cost of building subsystems; authorizing use of the 911 emergency telephone service fee to aid local units for sites and equipment in support of mutual aid and emergency medical communications services; requiring the commissioner of public safety to convene and chair a planning committee to develop a project plan for a statewide shared trunked public safety radio communication system, specifying certain membership, advisory group, plan content and reporting requirements, requiring local government units receiving state funds for the system to agree to participate in the system and to comply with project plan standards and guidelines; temporarily requiring the court to order criminal offenders to provide additional biological specimens for future DNA analysis and requiring the commissioner of corrections or local corrections authorities to collect the additional specimens before completion of the term of imprisonment under certain conditions, requiring forwarding of the specimens to the bureau of criminal apprehension (BCA); expanding the crime of first degree murder to causing the death of a human being while committing, conspiring to commit or attempting to commit an act of terrorism; creating the crime of damage to property of critical public service facilities, utilities and pipelines, prescribing penalties, providing immunity from prosecution for employees detaining suspicious persons; creating the crime of trespass on the grounds of critical public service facility, utility or pipeline property, imposing penalties, specifying certain sign posting requirements and providing immunity from prosecution for employees detaining suspicious persons, authorizing peace officer arrest without warrant upon probable cause; creating the crime of manufacture, possession or use of real or simulated weapons of mass destruction and certain prohibited substances, prohibiting threats involving the weapons, prescribing penalties, authorizing civil actions to recover damages; defining crimes committed in furtherance of terrorism, prescribing an enhanced penalty ARTICLE 2 APPROPRIATIONSAppropriating money to the commissioner of public safety for grants for the purchase of terrorism response related equipment, for terrorism response related training, for reimbursement of bomb disposal units, for the conversion of the Rochester, Moorhead and Duluth chemical assessment teams to combination emergency response chemical assessment teams, for chemical assessment teams, for increased security for the capitol complex, for salaries and expanses relating to updating the 800 megahertz executive team report for the statewide shared trunked radio and communications system, for additional collection of biological specimens for DNA testing and for the Minnesota emergency medical services (EMS) regulatory board for grants to medical resource control centers and to the commissioner of administration for 911 emergency telephone service; requiring the commissioner of public safety to report to the legislature by certain dates on use of appropriated funds (Ch. 401, 2002)
