HF 2514 Senate Long Description

Expanding the emergency authority of the board of animal health to eradicate dangerous, infectious or communicable diseases affecting domestic animals; requiring the board upon determination of the existence of a confirmed case of a disease presenting a substantial and imminent threat to the domestic animal population in the state to certify the case to the governor and authorizing the governor after receipt of certification to declare an emergency to allow the board to establish quarantine zones of control to protect animal health, requiring declaration specification of the applicable time period and filing with the secretary of state; authorizing the board to meet by electronic means for confirmed case declaration purposes, specifying certain notice and access requirements; authorizing and providing for the board or designated licensed veterinarian upon declaration of an emergency to establish quarantine zones of control based on veterinary examination or laboratory testing to protect the health of domestic animals, specifying certain area and duration restrictions; authorizing and providing for board issuance of orders restricting the movement of persons, livestock, machinery and personal property out of the zones; restricting the duration of temporary emergency restrictions, providing for court hearing for emergency restrictions continuation purposes under certain conditions, specifying certain notice requirements and conditions for the issuance of orders to continue the restrictions, imposing penalties for violation; clarifying and temporarily expanding the authority of the board relating to emergency suppression and eradication of dangerous, infectious or communicable diseases among animals relating to appraisal and destruction of animals and personal property and authorizing the governor at the request of the board to temporarily commandeer agricultural or other suitable nonresidential land to be used for disposal of destroyed animals under certain board determination conditions, requiring the payment of certain damages to the landowner; prohibiting proceedings to collect debts from owners of destroyed animals or personal property until owner receipt of compensation, specifying certain court order recording or filing requirements for application of the prohibition to proceedings involving title to real property; temporarily waiving a certain rule restricting the sale or distribution of biological products and antigens for products used exclusively for poultry (Ch. 192, 2001)
