1.1 A bill for an act 1.2 relating to agriculture; changing certain requirements 1.3 for handling eggs; amending Minnesota Statutes 1998, 1.4 sections 29.23, subdivisions 2, 3, and 4; and 29.26. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1998, section 29.23, 1.7 subdivision 2, is amended to read: 1.8 Subd. 2. [EQUIPMENT.] The commissioner shall also by rule 1.9 provide for minimum plant and equipment requirements for 1.10 candling, grading, handling and storing eggs, and shall define 1.11 candling.Equipment in use before July 1, 1991, that does not1.12meet the design and fabrication requirements of this chapter may1.13remain in use if it is in good repair, capable of being1.14maintained in a sanitary condition, and capable of maintaining a1.15temperature of 50 degrees Fahrenheit (10 degrees Celsius) or1.16less.1.17 Sec. 2. Minnesota Statutes 1998, section 29.23, 1.18 subdivision 3, is amended to read: 1.19 Subd. 3. [EGG TEMPERATURE.] Eggs must be held at a 1.20 temperature not to exceed 50 degrees Fahrenheit (10 degrees 1.21 Celsius) after being received by the egg handler except for 1.22 cleaning, sanitizing, grading, and further processing when they 1.23 must immediately be placed under refrigeration that is 1.24 maintained at 45 degrees Fahrenheit (7 degrees Celsius) or 1.25 below. Eggs offered for retail sale must be held at a 2.1 temperature not to exceed4541 degrees Fahrenheit (75 degrees 2.2 Celsius).After August 1, 1992, eggs offered for retail sale2.3must be held at a temperature not to exceed 45 degrees2.4Fahrenheit (7 degrees Celsius). Equipment in use prior to2.5August 1, 1991, is not subject to this requirement.2.6 Sec. 3. Minnesota Statutes 1998, section 29.23, 2.7 subdivision 4, is amended to read: 2.8 Subd. 4. [VEHICLE TEMPERATURE.] A vehicle used for the 2.9 transportation of shell eggs from a warehouse, retail store, 2.10 candling and grading facility, or egg holding facility must have 2.11 an ambient air temperature of5045 degrees Fahrenheit (107 2.12 degrees Celsius) or below. 2.13 Sec. 4. Minnesota Statutes 1998, section 29.26, is amended 2.14 to read: 2.15 29.26 [EGGS IN POSSESSION OF RETAILER.] 2.16 All eggs sold or offered for sale at retail must have been 2.17 candled and graded and must be clearly labeled according to 2.18 Minnesota consumer grades as established by rule under section 2.19 29.23. No eggs shall be sold or offered for sale as "ungraded," 2.20 "unclassified," or by any other name that does not clearly 2.21 designate the grade. All eggs in possession of the retailer, 2.22 either in temporary storage or on display, must be held at a 2.23 temperature not to exceed4541 degrees Fahrenheit (75 degrees 2.24 Celsius). 2.25 Candled and graded eggs held 31 days past the coded pack 2.26 date lose their grades and must be removed from sale.
