  1.1                          A bill for an act 
  1.2             relating to animals; creating a felony for certain 
  1.3             acts of cruelty to animals; defining felonious acts of 
  1.4             cruelty to animals; imposing a penalty; amending 
  1.5             Minnesota Statutes 1998, section 343.21, subdivision 
  1.6             9; and by adding a subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 343.21, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 7a.  [AGGRAVATED CRUELTY.] No person shall 
  1.11  intentionally starve any animal to death or kill any animal by a 
  1.12  means intentionally causing the animal unnecessary pain and 
  1.13  suffering. 
  1.14     Sec. 2.  Minnesota Statutes 1998, section 343.21, 
  1.15  subdivision 9, is amended to read: 
  1.16     Subd. 9.  [PENALTY.] A person who fails to comply with 
  1.17  violates any provision of this section subdivisions 1 to 7 is 
  1.18  guilty of a misdemeanor.  A person convicted of a second or 
  1.19  subsequent violation of subdivision 1 or 7 within five years of 
  1.20  a previous violation of subdivision 1 or 7 is guilty of a gross 
  1.21  misdemeanor.  A person who violates subdivision 7a is guilty of 
  1.22  a felony and may be sentenced to imprisonment for not more than 
  1.23  two years or to payment of a fine of not more than $4,000, or 
  1.24  both.
