E Imposing felony penalties for certain repeat violations of the prohibition on driving while under the influence of alcohol or controlled substance; authorizing imposition of a term of imprisonment or a fine or both, requiring a certain minimum term of incarceration or a program of intensive supervision with a lesser term of imprisonment as a condition of stay of sentence execution, authorizing the court to order home detention or an intensive probation program as part of the longer minimum incarceration requirement; modifying the conditions for motor vehicles subject to forfeiture; requesting the sentencing guidelines commission to amend the sentencing guidelines to assign one criminal history point to the felony violations and to include in the nonexclusive list of aggravating factors justifying an upward departure from the sentencing guidelines past history of impaired driving convictions and alcohol based license revocations of DWI offenders for incidents not part of the current felony offense; establishing the driving while impaired felony working group, specifying membership requirements and requiring the group to study and make recommendations relating to the appropriateness of felony level impaired driving penalties, of committing offenders to the custody of the commissioner of corrections, of stayed sentences, of subjection of impaired driving offenses to the sentencing guidelines grid, of mandatory prison sentences, of incarceration, treatment and supervision options and of a statutory maximum sentence and to consider the fiscal implications of felony level impaired driving penalties, requiring a report with findings and recommendations to the legislature by a certain date; requiring the commissioner of corrections to prepare a plan relating to supervision of felony level impaired driving offenders, specifying certain plan requirements and requiring a report to the legislature by a certain date, requiring cooperation with the working group; sunsetting the felony penalties, providing for resentencing motions in case of expiration; appropriating money to the commissioner to select in consultation with the commissioner of human services locations to house felony level impaired driving offenders and to predesign changes needed to accommodate the offenders, specifying certain public hearing requirements (mk, ja)
