  1.1                          A bill for an act 
  1.2             relating to human services; expanding eligibility for 
  1.3             the senior citizen drug program on a contingent basis; 
  1.4             amending Minnesota Statutes 1998, section 256.955, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 256.955, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 2a.  [CONTINGENT ELIGIBILITY CRITERIA.] (a) Within 
  1.10  the limits of available appropriations, the commissioner shall 
  1.11  expand program eligibility in the following order: 
  1.12     (1) asset limits shall be increased but shall not exceed 
  1.13  $8,000 for a single person and $12,000 for a married couple; 
  1.14     (2) income limits shall be increased but shall not exceed 
  1.15  175 percent of the federal poverty guidelines; and 
  1.16     (3) eligibility shall be expanded to include a person who 
  1.17  is disabled according to section 256D.35, subdivision 8a. 
  1.18     (b) The commissioner may make periodic adjustments to the 
  1.19  eligibility criteria in paragraph (a) after providing a 30 days' 
  1.20  notice to affected enrollees in order to keep expenditures 
  1.21  within the amount appropriated.
