  1.1                          A bill for an act 
  1.2             relating to human services; allowing alternative 
  1.3             rate-setting methodologies for day training and 
  1.4             habilitation vendors; appropriating money; proposing 
  1.5             coding for new law in Minnesota Statutes, chapter 252. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [252.461] [ALTERNATIVE RATE-SETTING 
  1.8   METHODOLOGIES.] 
  1.9      (a) The commissioner may approve alternative rate-setting 
  1.10  methodologies for identified day training and habilitation 
  1.11  vendors recommended by the day training and habilitation task 
  1.12  force established under Laws 1999, chapter 152, that are 
  1.13  supported by all members of the task force.  Any alternative 
  1.14  rate-setting methodology approved under this section must sunset 
  1.15  upon implementation of the new statewide payments rate structure 
  1.16  recommended by the task force in its report to the legislature 
  1.17  on January 15, 2001. 
  1.18     (b) The commissioner may grant a variance to any of the 
  1.19  provisions in sections 252.451, subdivision 5; 252.46, except 
  1.20  subdivision 16; and Minnesota Rules, part 9525.1290, subpart 1, 
  1.21  items A and B, necessary to implement the alternative 
  1.22  rate-setting methodologies approved by the task force under 
  1.23  paragraph (a). 
  1.24     Sec. 2.  [AMENDMENT.] 
  1.25     By June 1, 2000, the commissioner shall seek an amendment 
  2.1   to the state Medicaid plan to permit implementation of section 1.
  2.2      Sec. 3.  [TASK FORCE EXTENDED; REPORT.] 
  2.3      The day training and habilitation task force established 
  2.4   under Laws 1999, chapter 152, shall be extended to June 15, 
  2.5   2001.  The task force shall present a report recommending a new 
  2.6   payment rate schedule for day training and habilitation services 
  2.7   to the legislature by January 15, 2001. 
  2.8      Sec. 4.  [APPROPRIATION.] 
  2.9      $....... is appropriated from the general fund to the 
  2.10  commissioner of human services for technical assistance to the 
  2.11  task force. 
  2.12     Sec. 5.  [EFFECTIVE DATE.] 
  2.13     Sections 1 to 4 are effective the day following final 
  2.14  enactment.
