Modifying certain provisions under the environmental response and liability act (superfund); requiring consideration of a letter from the commissioner of the pollution control agency of removal or remedial action requirement exemption as an approved response action plan for contamination cleanup program grant eligibility for the filling of certain sites; expanding eligibility under the landfill cleanup program to certain additional closed sites permitted by the PCA, specifying an application deadline and extending the statute of limitations for claims for recovery of environmental response costs relating to the facilities; requiring a certain cash amount as proof of financial responsibility by owners or operators of qualified facilities under the program; requiring the deposit of revenue received by the commissioner from the sale or lease of real property for response action purposes in the solid waste fund and requiring the commissioner of finance to annually transfer a certain amount from the fund to a perpetual care account within the fund to be used for perpetual care at qualified facilities closed for more than a certain number of years, requiring management of the account by the state board of investment; authorizing use of money in the solid waste fund until a certain date to pay for private water supply well monitoring and health assessment costs of the commissioner of health in areas affected by unpermitted mixed municipal solid waste disposal facilities and to perform environmental assessments and response action at unpermitted facilities; establishing a municipal dump cleanup grant program for certain qualified sites, specifying application requirements and priorities, requiring PCA commissioner biennial reports to the legislature on the status of grant projects; providing for cleanup cost recovery actions by cities, towns or counties or the attorney general and for disposition of recovered amounts; exempting the state from liability under the program; appropriating money to the commissioner for the grants and to evaluate unpermitted mixed municipal solid waste disposal facilities to determine the presence and concentration of hazardous substances, pollutants or contaminants and decomposition gases and the boundaries of fill areas, requiring a report to the legislature with recommendations for inclusion of sites in the municipal dump cleanup program; repealing the use of money in the metropolitan landfill contingency action fund for water supply monitoring and health assessments (ja)
