1.1 A bill for an act 1.2 relating to real property; allowing owners of common 1.3 interest property to make certain unit modifications; 1.4 proposing coding for new law in Minnesota Statutes, 1.5 chapter 515B. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. [515B.3-122] [RIGHT OF RESIDENTIAL UNIT OWNERS 1.8 TO MAKE CERTAIN UNIT MODIFICATIONS.] 1.9 (a) A unit owner of a unit in residential use may make 1.10 modifications to the unit necessary to reasonably accommodate 1.11 the disability or personal security needs of the owner or a 1.12 person residing in the unit. Declarations, bylaws, or other 1.13 agreements may not prohibit these modifications but may 1.14 reasonably regulate the style and quality of the modifications. 1.15 (b) Notwithstanding any contrary provision of section 1.16 515B.1-102, this section applies to all common interest 1.17 communities created under chapter 515, 515A, or this chapter, 1.18 regardless of when created. The right to make modifications 1.19 under this section may not be waived. 1.20 (c) This section does not apply to restrictions on 1.21 modifications imposed by statute, rule, or ordinance.
