E Modifying certain provisions relating to child welfare and placement; requiring the state registrar to provide copies of original birth certificates of adopted persons to authorized representatives of federally recognized American Indian tribes to determine eligibility of the adopted persons for enrollment or membership in the tribe, restricting use to provide information to the adopted person on the birth parents; requiring the commissioner of human services to explore and experiment with different chemical dependency service models for parents with children found to be in need of chemical dependency treatment under certain maltreatment, foster care placement or disposition assessments and to evaluate the effectiveness of different chemical dependency treatment models for high risk populations for annual reporting to the legislature, providing for chemical dependency fund services for children found to be in need; providing for the continued availability of funds under agreements between the commissioner and licensed child placing agencies for placement of a specific child; expanding child welfare targeted case management services under medical assistance (MA) to tribal social services and providing for negotiated payment rates for the services; removing the definition of case coordination services from the definition of family based services under the Minnesota family preservation act; modifying a certain requirement for county selection of the expanded service option for family preservation fund grant use purposes and expanding child welfare targeted case management services to tribal social services; requiring local social services agencies to make diligent efforts to identify, locate and offer services to both parents of children placed in residential facilities by court order or by voluntary release by the parents and providing for day to day care and for agency petitions on behalf of noncustodial parents for custody under certain conditions; modifying and expanding certain case plan content requirements; creating a preference for placing siblings together in foster care and adoption situations; clarifying certain agency parental notice requirements relating to voluntary placement of children in foster care and modifying certain relative search and placement review requirements; expanding the scope of relative custody assistance to important friends and modifying certain definitions, the relationship between relative custody assistance and certain other assistance programs and the appeal process; modifying certain provisions under the adoption assistance program relating to appeal and the reimbursement of certain costs; expanding eligibility and certification statement requirements for postadoption assistance grants; modifying certain provisions under the juvenile court act relating to the purpose of laws governing the termination of parental rights and reasonable efforts towards rehabilitation and reunification; clarifying the definition of child in need of protection or services relating to voluntary placement or release; modifying the definition of relative and expanding the definition of egregious harm; modifying the procedure for responsible social services agency review of foster care status and for petitions or orders for relief from domestic child abuse; expanding certain court notice requirements relating to children in need of protection or services; requiring certain court determinations at detention hearings and specifying certain case plan requirements; modifying certain disposition requirements, authorizing court orders for placement of the child into the home and dismissal of responsible social services agencies from the case under certain conditions and modifying certain provisions providing for review of court ordered placements and permanent placement determinations; modifying certain requirements for the termination of parental rights; authorizing counties to establish alternative response programs for child protection assessments or investigations and providing for assessments and investigations under the established alternative programs, specifying certain duties and powers of local welfare and law enforcement agencies in response to child maltreatment reports and certain documentation requirements; requiring county community social service plans to address the use of the alternative programs, requiring inclusion in the plans and specifying certain plan requirements; authorizing the commissioner to develop guidelines defining alternative responses and procedures for family assessment and service delivery; modifying or clarifying certain definitions for child maltreatment reporting purposes and clarifying or expanding certain reporting requirements and the liability immunity provision; specifying the agencies responsible for assessing or investigating reports of alleged child maltreatment in facilities; requiring and providing for screening for substance abuse under certain conditions; providing for certain notice of the status of the report to informers; clarifying certain data release provisions; requiring designation of a member of multidisciplinary child protection teams as the lead person responsible for coordinating team activities with battered women programs and services; requiring the commissioner to amend chemical dependency assessment criteria under certain rules to include assessment criteria addressing issues relating to parents with open child protection cases due to chemical abuse; specifying certain reference substitution instructions to the revisor of statutes; repealing certain rulemaking requirements of the commissioner of human services relating to the placement of children in foster homes (mk, ja) ;
