E Modifying certain special education and student disciplinary provisions for children with disabilities; requiring and providing for involvement of the individual education plan team upon student suspension from current education placement and requiring school district review of the relationship between the disability and the behavior subject to disciplinary action and determination of the appropriateness of the education plan before expulsion or exclusion; lowering the maximum age for interagency intervention and special instruction and services eligibility purposes; eliminating references to federal law in the requirements for school districts to provide special instruction and services to children with disabilities and for the state board of education to adopt instruction rules; modifying the procedure for selection of hearing officers under the impartial due process hearing process; subjecting state, county and city government agencies responsible for providing services or resources to students with disabilities to the same dispute resolution systems as local school districts, requiring compliance with corrective action requirements; granting nonpublic schools serving students on a shared time basis access to the due process hearing system, authorizing the commissioner of children, families and learning to withhold public funds from nonpublic schools impeding public school district provision of appropriate educational services; delaying the effective date of the provision requiring school districts to seek reimbursement from insurers or third parties for the cost of health services provided to children with disabilities; requiring and providing for school district special education advisory councils to increase parental involvement; eliminating certain responsibilities of interagency early intervention committees; modifying the time limit for development of early intervention services transition plans; requiring state agency committee (SAC) determination of the development and disposition of corrective action orders for nonschool agencies and authorizing sanctions for failure to comply with the orders; eliminating the requirement for the department of children, families and learning to develop or identify an education screening tool for use in residential facilities; including interpreter and transliterator fees in litigation and hearing costs for reimbursement purposes and eliminating certain cost reimbursement limits and restrictions; requiring the commissioner to adopt, amend, revise or repeal certain existing rules; repealing a certain rule (ra, ja)
