Modifying certain provisions providing for services to persons with developmental disabilities or mental retardation; clarifying the destination of license holder death or serious injury reports; requiring demonstration of ability for license holder staff administration of medications; including temporary service suspensions in certain proposed termination of services notice requirements; modifying certain requirements for the handling of consumer funds; modifying certain family support program funds allocation requirements; modifying the personal care assistant supervision standard under medical assistance (MA); removing a certain restriction on medical assistance coverage for home health services for residents of health care facilities; modifying certain assessment requirements for coverage of home care services, requiring face to face assessments, providing a service update exception; modifying the definition of home care services; modifying the disqualification procedures for personal care assistants convicted of certain crimes; modifying and expanding medical assistance coverage of home care services; modifying a certain hardship exception to the exclusion from coverage for personal care services provided by certain relatives; requiring prior authorization of service updates and requests for temporary services; changing personal care assistance shared care services to shared personal care assistance services; providing for flexible use of personal care assistant hours within the length of service authorization to more effectively meet the needs and schedule of the recipient or responsible party; providing a fiscal agent option for personal care assistant services, duties; limiting medical assistance payments for shared private duty nursing services; expanding medical assistance coverage for community based crisis services for residents of intermediate care facilities for persons with mental retardation (ICF MR), authorizing coverage for the services at respite sites; providing for coordinated service delivery for American Indian recipients; subjecting enrollees under the demonstration project choosing not to develop a personal support plan to network and prior authorization requirements of the county administrative entity or service delivery organization within a certain number of days of enrollment; providing for risk sharing under the capitation payment system; modifying the funding for external advocacy services; providing for a phase-in of service coordination implementation at demonstration sites (mk)
