Exempting the state, state agencies or local government units or persons acquiring property from the entities from liability for damages for death, personal injury or disease attributable to the release of a hazardous substance, pollutant, contaminant or petroleum tank releases from facilities on property acquired by eminent domain under certain voluntary response action plan preparation, corrective action implementation or redevelopment or development plan adoption conditions; eliminating the requirement for court appointed commissioners under eminent domain provisions to make express findings of the estimated cost of removal and remedial actions necessary due to existing environmental contamination, requiring and providing for the commissioners to perform bifurcated assessments in determining the award of damages for property with hazardous substances, pollutants or contaminants present in the soil and or groundwater (ground water) and requiring bifurcated appeals(mk)
