E Relating to intermediate care facilities for persons with mental retardation and related conditions; modifying certain determination and redetermination of need requirements of the commissioner of human services; applying certain group residential housing (GRH) rates to an ICF MR licensing exception in Dakota county; providing for ICF MR local system needs planning, specifying host county responsibility and providing for consumer needs and preferences; requiring the commissioner of human services to appoint a temporary statewide advisory committee, specifying membership requirements and duties; specifying certain responsibilities of the commissioner, specifying certain contracting requirements; modifying the contracting system for the determination of ICF MR payment rates under medical assistance (MA) and requiring the commissioner to make certain contract recommendations to the legislature by a certain date; providing for implementation of an ICF MR payment system, providing for the determination of total, operating and property payment rates, for variable and other rate adjustments for use under certain conditions, for property rates for relocated facilities and for temporary rate adjustments to address occupancy and access; specifying certain facility financial recordkeeping and reporting requirements; requiring the payment of training and habilitation services costs as a passthrough at the lowest rate paid for comparable services at the site for day training and habilitation services, prohibiting inclusion in the computation of the total payment rate; requiring the commissioner to exempt certain newly established facilities from payment rate reductions; providing for the arraying of facilities within each grouping by the cost per resident day for spend-up limit purposes; repealing the client reimbursement classifications, the client assessment requirements under the community based services reimbursement rate system and a certain ICF MR total payment rate inflation adjustment requirement of the commissioner (ra, ja)
