Granting nursing home residents the right to request and consent to the use of physical restraints to treat medical symptoms under the patients bill of rights, defining medical symptoms; requiring nursing homes upon receiving the requests to inform the residents of alternatives to and the risks involved with the use of physical restraints; requiring a signed consent form and written order from the attending physician to provide physical restraints to residents; specifying certain responsibilities of nursing homes providing restraints, liability immunity provision; providing for the determination of compliance by nursing facilities with state and federal standards for the use of physical restraints by the commissioner of health; requiring the commissioner to grant waivers for the continuation of approved nurse aide training, competency evaluation or training and competency evaluation programs conducted by or on the site of certain nursing facilities receiving immediate jeopardy citations from the federal government between certain dates for violations of regulations governing the use of physical restraints and to notify the board of nursing home administrators by a certain date of the recommendation to the federal government of no facility fines (Ch. 83, 1999)
