  1.1                          A bill for an act 
  1.2             relating to local government; adding a position to a 
  1.3             list for certain purposes; establishing and providing 
  1.4             the powers and duties of the midtown planning and 
  1.5             coordination board; removing an age ceiling for new 
  1.6             firefighters in Minneapolis; amending Laws 1969, 
  1.7             chapter 937, section 1, subdivision 9a, as amended; 
  1.8             repealing Laws 1959, chapter 213. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Laws 1969, chapter 937, section 1, subdivision 
  1.11  9a, as added by Laws 1986, chapter 473, section 17, and amended 
  1.12  by Laws 1988, chapter 433, section 2, is amended to read: 
  1.13     Subd. 9a.  The city council shall by ordinance indicate the 
  1.14  manner in which the following positions are appointed: 
  1.15     (a) Director of federal employment and training; 
  1.16     (b) Director of inspections; 
  1.17     (c) Director of women/minorities business enterprise; 
  1.18     (d) Government relations representative; 
  1.19     (e) Risk manager; 
  1.20     (f) Deputy finance officer; 
  1.21     (g) Assistant budget director; 
  1.22     (h) Manager of sales and marketing at the convention 
  1.23  center; 
  1.24     (i) Director of community crime prevention; 
  1.25     (j) Deputy purchasing director; 
  1.26     (k) Urban corps. coordinator; 
  1.27     (l) Assistant director of licenses; 
  2.1      (m) Manager of employee benefits; 
  2.2      (n) Director of Public Information; 
  2.3      (o) Internal auditor; 
  2.4      (p) Director of labor relations; 
  2.5      (q) Director of affirmative action; 
  2.6      (r) Executive director, civilian police review authority. 
  2.7      The appointing authority shall not terminate an incumbent 
  2.8   holding a position listed under clause (b) for 270 days 
  2.9   following the effective date of this act, except for misfeasance 
  2.10  or malfeasance in office.  For 270 days after the first 270 
  2.11  days, the appointing authority shall not terminate an incumbent 
  2.12  holding a position listed under this subdivision, except for 
  2.13  misfeasance or malfeasance in office, without vote of approval 
  2.14  of a majority of the council. 
  2.15     Sec. 2.  [MIDTOWN PLANNING AND COORDINATION BOARD.] 
  2.16     Subdivision 1.  [ESTABLISHED.] The midtown planning and 
  2.17  coordination board is established. 
  2.18     Subd. 2.  [PURPOSE.] The purpose of the board is to do 
  2.19  planning for the Lake Street corridor area along with and 
  2.20  including neighborhoods one-half mile on either side of Lake 
  2.21  Street in Minneapolis from the western city limits to the river, 
  2.22  and to do planning and coordination for economic development, 
  2.23  transportation, and residential renewal, with the cooperation of 
  2.24  affected government, civic, business, and neighborhood entities. 
  2.25     Subd. 3.  [MEMBERSHIP.] The board shall be composed of 11 
  2.26  members.  Three members must be appointed by the Minneapolis 
  2.27  city council from among its members; three by the Hennepin 
  2.28  county board, from among its members; one by the Minneapolis 
  2.29  park board, from among its members; one by the metropolitan 
  2.30  council, from among its members; two members of the public 
  2.31  appointed by the Minneapolis city council; two members of the 
  2.32  public appointed by the Hennepin county board; and one member 
  2.33  appointed by the member of Congress from the fifth district.  
  2.34  The public members must reside or do business in the affected 
  2.35  area. 
  2.36     Subd. 4.  [OFFICERS.] The chair of the board shall be 
  3.1   elected by, and from among, the members of the board for a 
  3.2   one-year term.  The chair shall preside at meetings of the 
  3.3   board, if present, and shall perform all other duties assigned 
  3.4   by the board or by law.  The board shall elect officers in 
  3.5   addition to the chair as it deems necessary for the conduct of 
  3.6   its duties. 
  3.7      Subd. 5.  [MEMBERSHIP TERMS.] The terms of the members 
  3.8   shall be three years with the terms ending on June 30, 2001. 
  3.9      Subd. 6.  [COMPENSATION AND MEMBERSHIP.] Compensation of 
  3.10  members, removal of members, and filling of membership vacancies 
  3.11  is governed by Minnesota Statutes, section 15.0575, if not 
  3.12  covered in this section. 
  3.13     Sec. 3.  [POWERS OF BOARD.] 
  3.14     Subdivision 1.  [GENERAL POWERS.] The board has all powers 
  3.15  that may be necessary or convenient to enable it to perform the 
  3.16  duties and responsibilities imposed on it by law.  The powers 
  3.17  include the specific powers enumerated in this section. 
  3.18     Subd. 2.  [EMPLOYEES.] The board shall prescribe all terms 
  3.19  and conditions for the employment of its employees including, 
  3.20  but not limited to, adopting a compensation and classification 
  3.21  plan for its employees.  Employees of the board are public 
  3.22  employees and are members of the Minnesota state retirement 
  3.23  system.  The board shall make the employer's contributions to 
  3.24  pension funds of its employees. 
  3.25     Subd. 3.  [GIFTS AND APPROPRIATIONS.] The board may accept 
  3.26  gifts, apply for and use grants or loans of money or other 
  3.27  property from the United States, the state, or any person for 
  3.28  any board purpose, and may enter into agreements required in 
  3.29  connection therewith, and may hold, use, and dispose of the 
  3.30  money or property in accordance with the terms of the gift, 
  3.31  grant, loan, or agreement relating to it. 
  3.32     Sec. 4.  [DURATION.] 
  3.33     The board continues to exist until expressly abolished by 
  3.34  law. 
  3.35     Sec. 5.  [REPEALER.] 
  3.36     Laws 1959, chapter 213, is repealed. 
  4.1      Sec. 6.  [EFFECTIVE DATE; LOCAL APPROVAL.] 
  4.2      Section 1 is effective the day after the approval by the 
  4.3   governing body of the city of Minneapolis is filed according to 
  4.4   Minnesota Statutes, section 645.021, subdivision 3. 
  4.5      Sec. 7.  [EFFECTIVE DATE.] 
  4.6      Sections 2 to 5 are effective the day after final enactment.
