  1.1                          A bill for an act 
  1.2             relating to agriculture; increasing the noncitizen 
  1.3             MFIP-S food portion and the "Minnesota grown" coupon 
  1.4             program; amending Minnesota Statutes 1997 Supplement, 
  1.5             section 256J.11, subdivision 2; repealing Minnesota 
  1.6             Statutes 1997 Supplement, section 256D.057. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.9   256J.11, subdivision 2, is amended to read: 
  1.10     Subd. 2.  [NONCITIZENS; FOOD PORTION.] For the period 
  1.11  September 1, 1997, to June 30, 1998, noncitizens who do not meet 
  1.12  one of the exemptions in section 412 of the Personal 
  1.13  Responsibility and Work Opportunity Reconciliation Act of 1996, 
  1.14  but were residing in this state as of July 1, 1997, are eligible 
  1.15  for the 6/10 9/10 of the average value of food stamps for the 
  1.16  same family size and composition until MFIP-S is operative in 
  1.17  the noncitizen's county of financial responsibility and 
  1.18  thereafter, the 6/10 9/10 of the food portion of MFIP-S.  
  1.19  However, federal food stamp dollars cannot be used to fund the 
  1.20  food portion of MFIP-S benefits for an individual under this 
  1.21  subdivision. 
  1.22     Of the average value, 3/10 shall be provided in food 
  1.23  coupons through the "Minnesota grown" coupon program established 
  1.24  in Laws 1997, chapter 216, section 7, subdivision 4.  
  1.25     Sec. 2.  [TRANSFER.] 
  1.26     The commissioner of finance shall transfer $1,917,000 from 
  2.1   the department of human services to the department of 
  2.2   agriculture for fiscal year 1998.  This amount to be transferred 
  2.3   shall be from the amount appropriated for fiscal year 1998 to 
  2.4   the department of human services to supplement certain 
  2.5   noncitizens who lost eligibility for the federal food stamp and 
  2.6   Supplemental Security Income programs under the provisions of 
  2.7   title IV of Public Law Number 104-193. 
  2.8      The commissioner of finance shall determine the amount 
  2.9   needed to implement section 1.  The balance of the amount 
  2.10  transferred shall be used for increasing the amount of food 
  2.11  coupons issued each month by the commissioner of agriculture for 
  2.12  eligible participants of the "Minnesota grown" coupon program 
  2.13  established in Laws 1997, chapter 216, section 7, subdivision 4. 
  2.14     Sec. 3.  [REPEALER.] 
  2.15     Minnesota Statutes 1997 Supplement, section 256D.057, is 
  2.16  repealed. 
  2.17     Sec. 4.  [EFFECTIVE DATE.] 
  2.18     Sections 1 to 3 are effective the day following final 
  2.19  enactment.
