  1.1                          A bill for an act 
  1.2             proposing an amendment to the Minnesota Constitution, 
  1.3             article XIII, section 5; requiring the use of lottery 
  1.4             proceeds to fund a tuition scholarship program for 
  1.5             state residents who attend a Minnesota college or 
  1.6             university or a professional baseball park, as 
  1.7             provided by the people. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [CONSTITUTIONAL AMENDMENT.] 
  1.10     An amendment to the Minnesota Constitution, article XIII, 
  1.11  section 5, is proposed to the people.  If the amendment is 
  1.12  adopted, the section shall read as follows: 
  1.13     Sec. 5.  The legislature shall not authorize any lottery or 
  1.14  the sale of lottery tickets, other than authorizing a lottery 
  1.15  and sale of lottery tickets for a lottery operated by the 
  1.16  state.  Sixty percent of the net proceeds from any state 
  1.17  operated lottery must be used to either fund a tuition 
  1.18  scholarship program for state residents who attend a Minnesota 
  1.19  college or university or finance the construction of a 
  1.20  professional baseball park, as provided by popular vote. 
  1.21     Sec. 2.  [SUBMISSION TO VOTERS.] 
  1.22     The proposed amendment must be submitted to the people at 
  1.23  the 1998 general election.  The question submitted shall be: 
  1.24     "Shall the Minnesota Constitution be amended to provide for 
  1.25  a popular vote on whether to use 60 percent of the lottery 
  1.26  proceeds for a tuition scholarship program for state residents 
  2.1   who attend a Minnesota college or university or a professional 
  2.2   baseball park?" 
  2.3                                      Yes .......
  2.4                                      No ........"
  2.5      Sec. 3.  [SUBMISSION TO VOTERS.] 
  2.6      The following question shall also be submitted to the 
  2.7   people at the 1998 general election: 
  2.8      "Shall the constitutionally dedicated portion of the 
  2.9   lottery proceeds be used:  
  2.10          for a scholarship program for residents who attend
  2.11            a Minnesota college or university ......., or
  2.12          for a professional baseball park .........
  2.13     Vote for one of the preceding alternatives." 
  2.14     The secretary of state may alter the form of the question 
  2.15  as appropriate for the purposes of the ballot.  
  2.16     The vote on the question provided by this section has 
  2.17  effect only if the constitutional amendment proposed by section 
  2.18  1 is approved.  
  2.19     If the amendment is approved, the constitutional allocation 
  2.20  of lottery proceeds shall be to whichever purpose receives the 
  2.21  greater vote.
