1.1 A bill for an act 1.2 relating to public administration; providing for a 1.3 negotiated agreement for a major league baseball park; 1.4 providing some terms; appropriating money. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [MAJOR LEAGUE BASEBALL PARK.] 1.7 (a) The entity that owns the major league baseball team 1.8 based in Minnesota, the holder of a class A license from the 1.9 Minnesota Racing Commission, and the director of the state 1.10 lottery, may negotiate before December 1, 1997, an agreement 1.11 that provides at least the following: 1.12 (1) the class A license holder agrees to house up to 1,500 1.13 slot machines and furnishings and equipment for games of 1.14 blackjack within its racetrack facility; 1.15 (2) the slot machines and blackjack game operation must be 1.16 paid for by the entity that owns the team and be under the 1.17 control of the director of the lottery; 1.18 (3) the director of the lottery agrees to contract with one 1.19 or more federally recognized Indian tribes to operate the slot 1.20 machines and blackjack game operation; 1.21 (4) as soon as sufficient proceeds are available, the 1.22 entity that owns the team must be reimbursed for its costs of 1.23 paying for and installing the slot machines and blackjack game 1.24 operators; 1.25 (5) after the entity that owns the team is fully reimbursed 2.1 as provided in clause (4) and until the time when a new major 2.2 league baseball park is built in the metropolitan area under the 2.3 agreement by the entity owning the major league baseball team 2.4 and after deductions for the management contract and other 2.5 necessary expenses authorized by the director, half of the 2.6 balance of the proceeds from the slot machines and blackjack 2.7 game operations must be paid to the holder of the class A racing 2.8 commission license for housing the slot machine and blackjack 2.9 game operations and half must go to the entity that owns the 2.10 major league baseball team to reimburse it for costs of 2.11 construction of the stadium; 2.12 (6) the entity owning the team shall own, operate, 2.13 maintain, and improve the baseball park in accordance with 2.14 current major league standards and pay for them out of its 2.15 baseball park revenues; 2.16 (7) the stadium may be built on a site acquired and 2.17 prepared by the city of Minneapolis or, if the city of 2.18 Minneapolis is not willing or able, by another local 2.19 governmental unit in the metropolitan area by agreement with the 2.20 entity that owns the team; 2.21 (8) when the owner is reimbursed for the construction of 2.22 the baseball park to the extent agreed upon, the balance of 2.23 proceeds from the slot machines and blackjack game operations 2.24 after deductions for the management contract and other necessary 2.25 expenses approved by the lottery director, must be distributed 2.26 as follows: 2.27 (i) the first $10,000,000 each year must be deposited in 2.28 the state treasury and credited to a professional sports stadium 2.29 reserve account hereby established that must be invested by the 2.30 state investment board as otherwise provided for state 2.31 retirement funds. The proceeds from the reserve account may 2.32 only be used for major professional sports facilities as 2.33 provided by law; and 2.34 (ii) half of the remainder to the holder of the class A 2.35 racing commission license and the other half of the remainder to 2.36 the general fund; and 3.1 (9) other terms that are deemed necessary or desirable by 3.2 the parties that are not inconsistent with this section and that 3.3 help to effect the public purposes of the economic development 3.4 of the horse racing industry, the economic viability of the 3.5 Indian community in Minnesota, and the preservation of major 3.6 league baseball in Minnesota for the health, welfare, enjoyment, 3.7 and economic benefit of the state and its citizens. 3.8 Sec. 2. [DEADLINE.] 3.9 The agreement under section 1 must be substantially 3.10 completed before December 1, 1997. 3.11 Sec. 3. [APPROPRIATIONS.] 3.12 The amounts necessary are appropriated from the proceeds of 3.13 the slot machines and blackjack game operations as provided in 3.14 this act. 3.15 Sec. 4. [EFFECTIVE DATE.] 3.16 Sections 1 to 3 are effective the day after their final 3.17 enactment.
