1.1 A bill for an act 1.2 relating to human services; modifying the calculation 1.3 of food stamp benefits for certain noncitizen 1.4 families; amending Laws 1997, chapter 85, article 1, 1.5 section 7, subdivision 2, as amended. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Laws 1997, chapter 85, article 1, section 7, 1.8 subdivision 2, as amended by Laws 1997, chapter 203, article 12, 1.9 section 7, is amended to read: 1.10 Subd. 2. [NONCITIZENS; FOOD PORTION.] For the period 1.11 September 1, 1997, to June 30, 1998, noncitizens who do not meet 1.12 one of the exemptions in section 412 of the Personal 1.13 Responsibility and Work Opportunity Reconciliation Act of 1996, 1.14 but were residing in this state as of July 1, 1997, are eligible 1.15 for the6/10 of theaverage value of food stamps for the same 1.16 family size and composition until MFIP-S is operative in the 1.17 noncitizen's county of financial responsibility and thereafter, 1.18 the6/10 of thefood portion of MFIP-S. However, federal food 1.19 stamp dollars cannot be used to fund the food portion of MFIP-S 1.20 benefits for an individual under this subdivision. 1.21 Sec. 2. [TRANSFER OF FUNDS FROM TANF RESERVE ACCOUNT.] 1.22 For the fiscal year ending June 30, 1998, $2,563,000 is 1.23 transferred from the MFIP-S/TANF reserve account to the general 1.24 fund. For the fiscal year ending June 30, 1998, $2,563,000 is 1.25 appropriated from the general fund to the commissioner of human 2.1 services for the purposes of section 1. 2.2 Sec. 3. [EFFECTIVE DATE.] 2.3 Sections 1 and 2 are effective the day following final 2.4 enactment.
