1.1 A bill for an act 1.2 relating to professions; authorizing the board of 1.3 electricity to grant rule variances; amending 1.4 Minnesota Statutes 1996, section 326.241, subdivision 1.5 2. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1996, section 326.241, 1.8 subdivision 2, is amended to read: 1.9 Subd. 2. [POWERS.] The board, or the complaint committee 1.10 on behalf of the board where authorized by law, shall have power 1.11 to: 1.12 (1) Elect its own officers. 1.13 (2) Engage and fix the compensation of inspectors, and hire 1.14 employees. The salary of the executive secretary shall be 1.15 established pursuant to chapter 43A. All agents and employees 1.16 other than contract inspectors shall be in the classified 1.17 service and shall be compensated pursuant to chapter 43A. All 1.18 inspectors shall hold licenses as master or journeyman 1.19 electricians under section 326.242, subdivision 1(1) or 2(1), 1.20 and shall give bond in an amount fixed by the board, conditioned 1.21 upon the faithful performance of their duties. 1.22 (3) Pay such other expenses as it may deem necessary in the 1.23 performance of its duties, including rent, supplies, and such 1.24 like. 1.25 (4) Enforce the provisions of sections 326.241 to 326.248, 2.1 and provide, upon request, such additional voluntary inspections 2.2 and reviews as it may deem appropriate. 2.3 (5) Issue, renew, refuse to renew, suspend, temporarily 2.4 suspend, and revoke licenses, censure licensees, assess civil 2.5 penalties, issue cease and desist orders, and seek injunctive 2.6 relief and civil penalties in court as authorized by section 2.7 326.242 and other provisions of Minnesota law. 2.8 (6) Adopt reasonable rules to carry out its duties under 2.9 sections 326.241 to 326.248 and to provide for the amount and 2.10 collection of fees for inspection and other services. The rules 2.11 shall include procedures and standards for granting variances 2.12 from Minnesota Rules, parts 3800.3619 and 3800.3620, and any 2.13 other rule governing approval of electrical equipment. All 2.14 rules shall be adopted in accordance with chapter 14.
