  1.1                          A bill for an act
  1.2             relating to health; establishing reimbursement rates 
  1.3             for a nursing facility relocated under the moratorium 
  1.4             exception process; amending Minnesota Statutes 1996, 
  1.5             section 256B.431, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 256B.431, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 2s.  [RATES FOR A RELOCATED FACILITY.] For a nursing 
  1.10  facility whose construction project was authorized pursuant to 
  1.11  section 144A.073, subdivision 5, paragraph (g), the operating 
  1.12  cost payment rates for the second location shall be determined 
  1.13  based on Minnesota Rules, part 9549.0057.  Subdivision 25, 
  1.14  paragraphs (b), clause (3); and (d), shall not apply until the 
  1.15  second rate year after the settle up cost report is filed.  
  1.16  Notwithstanding this section, real estate taxes and special 
  1.17  assessments paid by the second location, a 501(c)(3) nonprofit 
  1.18  corporation, shall be included in the payment rates determined 
  1.19  under this subdivision for all subsequent rate years.
