1.1 A bill for an act 1.2 relating to capital improvements; authorizing towns to 1.3 exercise eminent domain and other powers for purposes 1.4 of wastewater infrastructure; authorizing the sale of 1.5 state bonds; appropriating money for wastewater 1.6 infrastructure loans and grants; proposing coding for 1.7 new law in Minnesota Statutes, chapter 444. 1.8 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.9 Section 1. [444.28] [TOWNS; POWERS; RIGHT OF EMINENT 1.10 DOMAIN.] 1.11 Subdivision 1. [POWERS.] For the purpose of designing, 1.12 planning, improving, and constructing a wastewater treatment 1.13 system under section 446A.072, a town has all the powers given 1.14 it under section 115.50. 1.15 Subd. 2. [RIGHT OF EMINENT DOMAIN.] A town may exercise 1.16 the right of eminent domain to acquire private property within 1.17 or without the limits of the town for the purpose of carrying 1.18 out the authority provided in this chapter, including obtaining 1.19 the right-of-way for sewerage or drainage purposes and an outlet 1.20 for sewerage or drainage within or without the town limits. 1.21 Chapter 117 applies to the exercise of eminent domain under this 1.22 section. 1.23 Sec. 2. [MUNICIPALITIES; SEWER AND WASTEWATER TREATMENT 1.24 PROJECTS.] 1.25 $25,000,000 is appropriated from the bond proceeds fund to 1.26 the Minnesota public facilities authority for wastewater 2.1 infrastructure loans and grants to municipalities under 2.2 Minnesota Statutes, section 446A.072. 2.3 Sec. 3. [BOND SALE.] 2.4 To provide the money appropriated in this act from the 2.5 state bond proceeds fund, the commissioner of finance, on 2.6 request of the governor, shall sell and issue bonds of the state 2.7 in an amount up to $25,000,000 in the manner, upon the terms, 2.8 and with the effect prescribed by Minnesota Statutes, sections 2.9 16A.631 to 16A.675, and by the Minnesota Constitution, article 2.10 XI, sections 4 to 7. 2.11 Sec. 4. [EFFECTIVE DATE.] 2.12 This act is effective the day following final enactment.
