1.1 A bill for an act 1.2 relating to utilities; allowing certain electric 1.3 service connections with utilities not having the 1.4 assigned service area; amending Minnesota Statutes, 1.5 section 216B.42, subdivision 1. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1994, section 216B.42, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [LARGE CUSTOMERS OUTSIDE MUNICIPALITIES.] 1.10 Notwithstanding the establishment of assigned service areas for 1.11 electric utilities provided for in section 216B.39, 1.12 customerslocated outside municipalities andwho require 1.13 electric service with a connected load of 2,000 kilowatts or 1.14 more shall not be obligated to take electric service from the 1.15 electric utility having the assigned service area where the 1.16 customer is located.if, after notice and hearing, the1.17commission so determines after consideration of following1.18factors:1.19(a) the electric service requirements of the load to be1.20served;1.21(b) the availability of an adequate power supply;1.22(c) the development or improvement of the electric system1.23of the utility seeking to provide the electric service,1.24including the economic factors relating thereto;1.25(d) the proximity of adequate facilities from which2.1electric service of the type required may be delivered;2.2(e) the preference of the customer;2.3(f) any and all pertinent factors affecting the ability of2.4the utility to furnish adequate electric service to fulfill2.5customers' requirements.
