  1.1                          A bill for an act 
  1.2             relating to economic security; providing for the 
  1.3             settlement of extended employment program appeals; 
  1.4             authorizing independent audits by extended employment 
  1.5             program providers; appropriating money. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PURPOSE.] 
  1.8      The purpose of this act is to implement a settlement 
  1.9   agreement between the department of economic security, 
  1.10  rehabilitation services branch, and certain providers of 
  1.11  extended employment program services.  Implementation of the 
  1.12  agreement will resolve disputed audits for fiscal years 1991, 
  1.13  1992, and 1993, those audits having recently been completed by 
  1.14  the department of economic security pursuant to a schedule set 
  1.15  out in Laws 1995, chapter 224.  Settlement of the fiscal years 
  1.16  1991 to 1993 audits, in conjunction with implementation of an 
  1.17  audit procedure to expedite the completion of audits for fiscal 
  1.18  years 1994 and 1995 as provided for in this act, will resolve 
  1.19  all disputed audits, and necessary reconciliations, by June 30, 
  1.20  1997. 
  1.21     Sec. 2.  [FISCAL YEARS 1994 AND 1995 AUDITS.] 
  1.22     Subdivision 1.  [INDEPENDENT AUDITS AUTHORIZED.] Extended 
  1.23  employment service providers must secure an independent outside 
  1.24  audit for fiscal years 1994 and 1995 using audit standards 
  1.25  provided by the rehabilitation services branch of the department 
  2.1   of economic security and submit the reports of the audits to the 
  2.2   rehabilitation services branch by May 1, 1996. 
  2.3      Subd. 2.  [DEADLINE FOR ISSUING 1994 AND 1995 
  2.4   RECONCILIATION.] Ninety days after the receipt of all the audit 
  2.5   reports for fiscal years 1994 and 1995, the rehabilitation 
  2.6   services branch shall issue a notice of reconciliation to each 
  2.7   extended employment service provider for each of the fiscal 
  2.8   years. 
  2.9      Subd. 3.  [RECONCILIATION COMPLETION.] Any funds paid to or 
  2.10  among extended employment service providers as a result of 
  2.11  fiscal years 1994 and 1995 reconciliation and completion of 
  2.12  appeals for 1991, 1992, and 1993, must take place by June 30, 
  2.13  1997, or at the completion of all appeals, whichever is later. 
  2.14     Sec. 3.  [APPROPRIATION; EXTENDED EMPLOYMENT PROGRAM 
  2.15  UNDERPAYMENTS.] 
  2.16     $725,000 is appropriated from the general fund for the 
  2.17  biennium ending June 30, 1997, to the commissioner of economic 
  2.18  security for the purpose of partially funding payment to 
  2.19  extended employment service providers that were underpaid 
  2.20  according to audits completed by the department of economic 
  2.21  security for fiscal years 1991, 1992, and 1993. 
  2.22     Sec. 4.  [EFFECTIVE DATE.] 
  2.23     This act is effective the day following final enactment.
