  1.1                          A bill for an act 
  1.2             relating to education; changing special education 
  1.3             excess cost aid; amending Minnesota Statutes 1995 
  1.4             Supplement, section 124.323, subdivision 2. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.7   124.323, subdivision 2, is amended to read: 
  1.8      Subd. 2.  [EXCESS COST REVENUE.] For 1996 and later fiscal 
  1.9   years, a district's special education excess cost revenue equals 
  1.10  the product greater of: 
  1.11     (1) 70 percent of the difference between (i) the district's 
  1.12  unreimbursed special education cost per actual pupil unit and 
  1.13  (ii) six percent for fiscal year 1996 and 5.7 percent for fiscal 
  1.14  year 1997 and later years of the district's general revenue per 
  1.15  actual pupil unit, times (2) the district's actual pupil units 
  1.16  for that year; or 
  1.17     (2) 70 percent of the difference between (i) the district's 
  1.18  unreimbursed special education costs attributed to a student 
  1.19  whose services are not included in the district's base revenue 
  1.20  for the current fiscal year and (ii) $20,000.
