1.1 A bill for an act 1.2 relating to statutes of limitations; reviving certain 1.3 civil actions barred by the statute of limitations; 1.4 proposing coding for new law in Minnesota Statutes, 1.5 chapter 541. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. [541.076] [ACTIONS FOR DAMAGES INVOLVING THE 1.8 INFUSION OF BLOOD PRODUCTS.] 1.9 Notwithstanding any other law to the contrary, an action 1.10 for damages involving the infusion of blood products by a person 1.11 with hemophilia, the spouse or children of a person with 1.12 hemophilia, or the estate of a person who had hemophilia that is 1.13 barred by the applicable statute of limitations on the effective 1.14 date of this act is revived and a civil action may be filed 1.15 provided that the action is filed within one year of the 1.16 effective date of this act. The provisions of this act shall 1.17 also apply to any such civil action which was dismissed prior to 1.18 the effective date of this act solely on the grounds that the 1.19 action was barred by the applicable statute of limitations. 1.20 Sec. 2. [EFFECTIVE DATE.] 1.21 Section 1 is effective the day following final enactment. 1.22 Sec. 3. [EXPIRATION DATE.] 1.23 Section 1 expires one year following final enactment.
