1.1 A bill for an act 1.2 relating to education; providing for remedial 1.3 instruction in public post-secondary institutions; 1.4 charge back of testing and instruction costs; 1.5 proposing coding for new law in Minnesota Statutes, 1.6 chapter 135A. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. [135A.081] [REMEDIAL INSTRUCTION; CHARGE BACK.] 1.9 Subdivision 1. [CONDITIONS.] A public post-secondary 1.10 institution may provide remedial instruction to the student to 1.11 try to increase the student's ability to permit the student to 1.12 comprehend the entry level course or program at the 1.13 institution's minimally acceptable standards if: 1.14 (1) a public high school in the state graduates a student; 1.15 (2) the student meets the minimum admission standards of a 1.16 public post-secondary institution in the state; 1.17 (3) the student is admitted to an entry level course or 1.18 program at the institution; 1.19 (4) within 12 months of first enrollment, the institution 1.20 determines that the student's English language reading or 1.21 writing ability, or both, or the student's mathematic ability 1.22 does not rise to the level that is a necessary prerequisite to 1.23 minimally acceptable comprehension of entry level courses or 1.24 programs at the institution; and 1.25 (5) the institution's determination is confirmed by 1.26 independently administered tests. 2.1 Subd. 2. [CONFIRMATION.] The institution's determination 2.2 of a student's substandard ability is confirmed if the student 2.3 scores below 12th grade level in a standardized test in any of 2.4 the following areas covered by the determination: English 2.5 language reading comprehension, English language composition, or 2.6 mathematics. The test must be administered by some responsible 2.7 person or entity other than the student's high school or the 2.8 post-secondary institution seeking the confirmation. 2.9 Subd. 3. [CHARGE BACK.] (a) The public post-secondary 2.10 institution that ordered the confirming tests may charge back to 2.11 the student's high school the full cost of a test that confirms 2.12 the institution's determination. 2.13 (b) The institution may also charge back to the student's 2.14 high school, according to the following schedule, the actual 2.15 incremental cost to the institution of the remedial instruction 2.16 not to exceed the per course or per comparable program cost of 2.17 entry level courses or programs at the institution: 2.18 Percent of cost of remedial Academic year 2.19 instruction provided in 2.20 academic year after 2.21 high school graduation 2.22 100 percent first 2.23 90 percent second 2.24 80 percent third 2.25 70 percent fourth 2.26 60 percent fifth 2.27 50 percent sixth 2.28 40 percent seventh 2.29 30 percent eighth 2.30 20 percent ninth 2.31 10 percent tenth 2.32 (c) If a second determination of substandard ability is 2.33 confirmed in the same subject area, the institution may charge 2.34 back to the student's high school the full cost of the 2.35 confirming test and half the amount otherwise permitted under 2.36 the schedule in paragraph (b). 3.1 Subd. 4. [NO CREDITS; STUDENT COSTS.] (a) A post-secondary 3.2 institution providing remedial instruction under this section 3.3 must not award credit to a student toward a degree or program 3.4 completion for remedial instruction provided under this section. 3.5 (b) The institution may charge the student for the actual 3.6 incremental costs of the remedial instruction less the amount 3.7 charged back to the student's high school. 3.8 Subd. 5. [JUST CLAIM.] A valid charge back for remedial 3.9 instruction to a student under this section is, under section 3.10 123.40, subdivision 1, a just claim against the school district 3.11 that includes the student's high school.
