1.1 A bill for an act 1.2 relating to wild animals; special permit issuance; 1.3 amending Minnesota Statutes 1994, section 97A.401, 1.4 subdivision 3. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 1994, section 97A.401, 1.7 subdivision 3, is amended to read: 1.8 Subd. 3. [TAKING, POSSESSING, AND TRANSPORTING WILD 1.9 ANIMALS FOR CERTAIN PURPOSES.] (a) Except as provided in 1.10 paragraph (b), special permits may be issued without a fee to 1.11 take, possess, and transport wild animals as pets and for 1.12 scientific, educational, and exhibition purposes. The 1.13 commissioner shall prescribe the conditions for taking, 1.14 possessing, transporting, and disposing of the wild animals. 1.15 (b) A special permit may not be issued to take or possess 1.16 wild or native deer for exhibition or propagation. 1.17 (c) The commissioner shall establish criteria for issuing 1.18 special permits for persons to possess wild and native deer as 1.19 pets. 1.20 (d) Special permits shall be issued to a person making a 1.21 sufficient showing of benefit to the migratory bird resource, 1.22 important research reasons, reasons of human concern for 1.23 individual birds, or other compelling justification under United 1.24 States Fish and Wildlife guidelines, Code of Federal 1.25 Regulations, title 50, part 21.27.
