  1.1                          A bill for an act 
  1.2             relating to agriculture; restricting sales of ethanol 
  1.3             plants; amending Minnesota Statutes 2002, section 
  1.4             41A.09, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 41A.09, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 9.  [REFUND OF PRODUCER PAYMENTS; APPROPRIATION.] (a) 
  1.9   A producer shall refund all payments received under subdivision 
  1.10  3a if the producer sells an ethanol plant that has produced 
  1.11  ethanol that has been reported for producer payments made under 
  1.12  this section in the 20 years preceding the date of sale.  The 
  1.13  commissioner of agriculture shall deposit the refund in the 
  1.14  general fund.  
  1.15     (b) Paragraph (a) does not apply to the sale of an ethanol 
  1.16  plant to a farmer-owned cooperative organized under chapter 308A.
  1.17     (c) The amount deposited under paragraph (a) is 
  1.18  appropriated from the general fund to the commissioner for 
  1.19  payments under subdivision 3a, and is available until expended. 
  1.20     [EFFECTIVE DATE.] This section is effective the day 
  1.21  following final enactment.
