A bill for an act
relating to human services; directing commissioner of human services to ensure
that generic drugs used in the medical assistance program are obtained at the
lowest price; amending Minnesota Statutes 2010, section 256B.04, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2010, section 256B.04, is amended by adding a
subdivision to read:

new text begin The commissioner shall implement a competitive bidding
process or comparable process such as soliciting supplemental rebates from generic drug
manufacturers to ensure that generic drugs purchased or reimbursed for recipients of
services under state health programs are obtained at the lowest price.
