  1.1                          A bill for an act 
  1.2             relating to public waters; restricting authority of 
  1.3             the board of water and soil resources and watershed 
  1.4             districts to require a permit or other approval for a 
  1.5             street or highway construction project; amending 
  1.6             Minnesota Statutes 2002, sections 103C.401, by adding 
  1.7             a subdivision; 103D.335, by adding a subdivision; 
  1.8             103D.345, subdivision 5. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2002, section 103C.401, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 3.  [AUTHORITY NOT GRANTED.] Nothing in this chapter 
  1.13  or other law may be construed to give the state board the 
  1.14  authority to require a permit or other approval for a street or 
  1.15  highway construction project undertaken by a road authority as 
  1.16  defined in section 160.02, subdivision 25. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 103D.335, is 
  1.18  amended by adding a subdivision to read: 
  1.19     Subd. 26.  [AUTHORITY NOT GRANTED.] Nothing in this chapter 
  1.20  or other law may be construed to give a watershed district the 
  1.21  authority to require a permit or other approval for a street or 
  1.22  highway construction project undertaken by a road authority as 
  1.23  defined in section 160.02, subdivision 25. 
  1.24     Sec. 3.  Minnesota Statutes 2002, section 103D.345, 
  1.25  subdivision 5, is amended to read: 
  1.26     Subd. 5.  [APPLICABILITY OF PERMIT REQUIREMENTS TO STATE.] 
  1.27  A rule adopted by the managers that requires a permit for an 
  2.1   activity applies to the department of transportation, except in 
  2.2   the case of trunk highway construction projects.
