                        CHAPTER 121-S.F.No. 1032 
           An act relating to crimes; increasing the penalty for 
          assaulting a correctional officer; amending Minnesota 
          Statutes 1990, section 609.2231, subdivision 3. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
    Section 1.  Minnesota Statutes 1990, section 609.2231, 
subdivision 3, is amended to read: 
    Subd. 3.  [CORRECTIONAL EMPLOYEES.] Whoever assaults an 
employee of a correctional facility as defined in section 
241.021, subdivision 1, clause (5), while the employee is 
engaged in the performance of a duty imposed by law, policy or 
rule, and inflicts demonstrable bodily harm, is guilty of a 
gross misdemeanor felony and may be sentenced to imprisonment 
for not more than one year two years or to payment of a fine of 
not more than $3,000 $4,000, or both. 
    Sec. 2.  [EFFECTIVE DATE.] 
    Section 1 is effective August 1, 1991, and applies to 
crimes committed on or after that date.
