           An act relating to health; enacting the uniform 
          determination of death act; proposing coding for new 
          law in Minnesota Statutes, chapter 145. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
    Section 1.  [145.135] [DETERMINATION OF DEATH.] 
    Subdivision 1.  [CITATION.] This section may be cited as 
the uniform determination of death act. 
    Subd. 2.  [DETERMINATION OF DEATH.] An individual is dead 
if the individual sustains irreversible cessation of: 
    (1) circulatory and respiratory functions; or 
    (2) all functions of the entire brain, including the brain 
stem. 
    A determination of death must be made in accordance with 
generally accepted medical standards.
