                        CHAPTER 271-S.F.No. 650 
           An act relating to crimes; increasing the penalty for 
          an offense committed against a transit provider or 
          operator when violence or a threat of violence is not 
          involved; amending Minnesota Statutes 1984, section 
          609.855, subdivision 4. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
    Section 1.  Minnesota Statutes 1984, section 609.855, 
subdivision 4, is amended to read: 
    Subd. 4.  [PENALTY.] Whoever violates subdivision 1, 2, or 
3 may be sentenced as follows:  
    (a) To imprisonment for not more than one year or to 
payment of a fine of not more than $3,000, or both, if the 
violation was accompanied by force or violence or a 
communication of a threat of force or violence; or 
    (b) To the penalty imposed in section 169.89, subdivision 2 
imprisonment for not more than 90 days or to payment of a fine 
of not more than $700, or both, if the violation was not 
accompanied by force or violence or a communication of a threat 
of force or violence.  
    Sec. 2.  [EFFECTIVE DATE.] 
    Section 1 is effective August 1, 1985, and applies to 
crimes committed on or after that date.
