  1.1                          A bill for an act 
  1.2             relating to housing; specifying certain discretionary 
  1.3             municipal subdivision authority; amending Minnesota 
  1.4             Statutes 2000, section 462.358, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 462.358, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 11.  [AFFORDABLE HOUSING.] For the purposes of this 
  1.10  subdivision, a "development application" means subdivision, 
  1.11  planned unit development, site plan, or other similar type 
  1.12  action.  A municipality, in approving a development application 
  1.13  that provides all or a portion of the units for persons and 
  1.14  families of low and moderate income, may, subject to agreement 
  1.15  by the applicant with respect to housing for persons of low and 
  1.16  moderate income: 
  1.17     (1) establish sales prices or rents for housing affordable 
  1.18  to low- and moderate-income households; 
  1.19     (2) establish maximum income limits for initial and 
  1.20  subsequent purchasers or renters of the affordable units; and 
  1.21     (3) establish means, including, but not limited to, land 
  1.22  trusts, equity sharing, or similar activities, to maintain the 
  1.23  long-term affordability of the affordable units.
