  1.1                          A bill for an act 
  1.2             relating to housing; specifying certain discretionary 
  1.3             municipal subdivision authority; amending Minnesota 
  1.4             Statutes 2000, section 462.358, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 462.358, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 11.  [AFFORDABLE HOUSING.] A municipality, in 
  1.10  adopting a planned unit development or subdivision regulations 
  1.11  and establishing standards, requirements, and procedures to 
  1.12  promote the availability of affordable housing to persons and 
  1.13  families of all income levels may, with respect to housing for 
  1.14  persons and families of low or moderate income:  
  1.15     (1) establish an initial sales price for the housing 
  1.16  required to be affordable to low- or moderate-income persons or 
  1.17  families in a development; 
  1.18     (2) require that property affordable to low- or 
  1.19  moderate-income persons or families be placed in a land trust; 
  1.20     (3) require deed restrictions to maintain affordability of 
  1.21  housing in a development affordable to low- or moderate-income 
  1.22  persons or families; and 
  1.23     (4) establish maximum income levels for low-income 
  1.24  purchasers of housing required to be affordable for low- or 
  1.25  moderate-income persons or families. 
  2.1      The authority granted to municipalities by this subdivision 
  2.2   applies only to units of housing in a development that are 
  2.3   designated as affordable to low- or moderate-income persons or 
  2.4   families.
