1.32 or fold down, chassis mounted campers, house cars, motor homes,
1.33 tent trailers, slip in campers, and converted buses that provide
1.34 temporary human living quarters. A vehicle is considered to
1.35 provide temporary living quarters if it:
  1.36     (1) is not used as the residence of the owner or occupant;
2.1 (2) is used for temporary living quarters by the owner or
  2.2   occupant while engaged in recreational or vacation activities;

2.6 (b) For the purposes of this subdivision, a motor home
2.7 means a unit designed to provide temporary living quarters,
2.8 built into as an integral part of, or permanently attached to, a
2.9 self-propelled motor vehicle chassis or van. A motor home must

2.22 of this subdivision, "permanently installed" means built into or

2.33 to the motor home definition in this paragraph and has been
2.34 completed or altered by the final stage manufacturer; and

2.36 is permanently attached a body designed to provide temporary
3.1 living quarters as defined in this paragraph.
3.2 (c) (d) Slip in campers are mounted into a vehicle commonly
3.3 known as a pickup truck, in the pickup box, either by bolting
3.4 through the floor of the pickup box or by firmly clamping to the
3.5 side of the pickup box. The vehicle must may not be registered
3.6 as a passenger automobile recreational vehicle.
  3.7 Sec. 2. Minnesota Statutes 1996, section 168.16, is

  3.9 168.16 [REFUNDS; APPROPRIATION.]
3.10 After the tax upon any motor vehicle shall have been paid
3.11 for any year, refund shall be made for errors made in computing
3.12 the tax or fees and for the error on the part of an owner who
3.13 may in error have registered a motor vehicle that was not
3.14 before, nor at the time of registration, nor at any time
3.15 thereafter during the current past year, subject to tax in this
3.16 state as provided by section 168.012. Unless otherwise provided
3.17 in this chapter, a claim for a refund of an overpayment of
3.18 registration tax must be filed within 3-1/2 years from the date
3.19 of payment. The refundment shall be made from any fund in
3.20 possession of the registrar and shall be deducted from the
3.21 registrar's monthly report to the commissioner of finance. A
3.22 detailed report of the refundment shall accompany the report.
3.23 The former owner of a transferred vehicle by an assignment in
3.24 writing endorsed upon the registration certificate and delivered
3.25 to the registrar within the time provided herein may sell and
3.26 assign to the new owner thereof the right to have the tax paid
3.27 by the former owner accredited to the owner who duly registers
3.28 the vehicle. Any owner at the time of such occurrence, whose
3.29 vehicle is declared by an insurance company to be a total loss
3.30 due to flood damage, permanently destroyed, or sold to the
3.31 federal government, the state, or political subdivision thereof,
3.32 and any owner who sells a rental motor vehicle and transfers the
3.33 license plates issued to that motor vehicle under section
3.34 168.15, subdivision 3, shall upon filing a verified claim be
3.35 entitled to a refund of the unused portion of the tax paid upon
3.36 the vehicle, computed as follows:
4.1 (1) if the vehicle is registered under the calendar year
4.2 system of registration, the refund is computed pro rata by the
4.3 month, 1/12 of the annual tax paid for each month of the year
4.4 remaining after the month in which the plates and certificate
  4.5   were returned to the registrar;
4.6 (2) in the case of a vehicle registered under the monthly
4.7 series system of registration, the amount of the refund is equal
4.8 to the sum of the amounts of the license fee attributable to
4.9 those months remaining in the licensing period after the month
4.10 in which the plates and certificate were returned to the
  4.11 registrar.
4.12 There is hereby appropriated to the persons entitled to a
4.13 refund, from the fund or account in the state treasury to which
4.14 the money was credited, an amount sufficient to make the refund
4.15 and payment. Refunds under this section to licensed motor
4.16 vehicle lessors must be made annually in a manner the registrar
  4.17 determines.
  4.18 Sec. 3. Minnesota Statutes 1996, section 168.33,

4.22 compensation of the necessary employees, in the manner provided
4.23 by law, as may be required to enable the registrar to properly
4.24 carry out the duties imposed by this chapter. The registrar may
4.25 appoint, and for cause discontinue, a deputy registrar for any
4.26 statutory or home rule charter city as the public interest and
4.27 convenience may require, without regard to whether the county
4.28 auditor of the county in which the city is situated has been
4.29 appointed as the deputy registrar for the county or has been
4.30 discontinued as the deputy registrar for the county, and without
4.31 regard to whether the county in which the city is situated has
4.32 established a county license bureau which issues motor vehicle
4.33 licenses as provided in section 373.32.
4.34 (b) The registrar may appoint, and for cause discontinue, a
4.35 deputy registrar for any statutory or home rule charter city as
4.36 the public interest and convenience may require, if the auditor
5.1 for the county in which the city is situated chooses not to
5.2 accept appointment as the deputy registrar for the county or is
5.3 discontinued as a deputy registrar, or if the county in which
5.4 the city is situated has not established a county license bureau
5.5 which issues motor vehicle licenses as provided in section
5.6 373.32. A person appointed by the registrar as a deputy
5.7 registrar for any statutory or home rule charter city must be a
5.8 resident of the county in which the city is situated.
5.9 (c) The registrar may appoint, and for cause discontinue,
5.10 the county auditor of each county as a deputy registrar. Upon
5.11 approval of the county board, the auditor, with the approval of
5.12 the director of motor vehicles, may appoint, and for cause
5.13 discontinue, the clerk or equivalent officer of each statutory
5.14 or home rule charter city or any other person as a deputy
5.15 registrar as public interest and convenience may require,
5.16 regardless of the appointee's county of residence. At the
5.17 request of the governing body of a statutory or home rule
5.18 charter city, the auditor shall appoint, and may for cause
5.19 discontinue, the clerk or equivalent officer of a city, or
5.20 another officer or employee of the city designated by the
5.21 governing body, as a deputy registrar:
5.22 (1) if the city is a county seat or, if not, is larger than
5.23 the seat of the county in which it is situated; and
5.24 (2) no office of a deputy registrar is situated within the
5.25 city or within 15 miles of the city by the most direct public
  5.26 route.
5.27 (d) Notwithstanding any other provision, a person other
5.28 than a county auditor or a director of a county license bureau,
5.29 who was appointed by the registrar before August 1, 1976, as a
5.30 deputy registrar for any statutory or home rule charter city,
5.31 may continue to serve as deputy registrar and may be
5.32 discontinued for cause only by the registrar. The county
5.33 auditor who appointed the deputy registrars is responsible for
5.34 the acts of deputy registrars appointed by the auditor. Each
5.35 deputy, before entering upon the discharge of duties, shall take
5.36 and subscribe an oath to faithfully discharge the duties and to
6.1 uphold the laws of the state. If a deputy registrar appointed
6.2 under this subdivision is not an officer or employee of a county
6.3 or statutory or home rule charter city, the deputy shall in
6.4 addition give bond to the state in the sum of $10,000, or a
6.5 larger sum as may be required by the registrar, conditioned upon
6.6 the faithful discharge of duties as deputy registrar.
  6.7 (e) Until January 1, 2009, a corporation governed by
6.8 chapter 302A may be appointed a deputy registrar. Upon
6.9 application by an individual serving as a deputy registrar and
6.10 the giving of the requisite bond as provided in this
6.11 subdivision, personally assured by the individual or another
6.12 individual approved by the commissioner of public safety, a
6.13 corporation named in an application shall become the duly
6.14 appointed and qualified successor to the deputy registrar. The
6.15 appointment of any corporation as a deputy registrar expires
6.16 January 1, 2009. A county board shall appoint, or the
6.17 commissioner shall appoint if the county board declines to do
6.18 so, an individual as successor to the corporation as a deputy
6.19 registrar. The county board or commissioner shall appoint as
6.20 the successor agent to a corporation whose appointment expires
6.21 under this paragraph an officer of the corporation if the
6.22 officer applies for appointment before July 1, 2009.
6.23 (f) Each deputy registrar appointed under this subdivision
6.24 shall keep and maintain, in a convenient public place within or
6.25 in close proximity to the place for which appointed, a
6.26 registration and motor vehicle tax collection bureau, to be
6.27 approved by the registrar, for the registration of motor
6.28 vehicles and the collection of taxes on motor vehicles. The
6.29 deputy registrar shall keep records and make reports to the
6.30 registrar as the registrar, from time to time, may require. The
6.31 records must be maintained at the facility of the deputy
6.32 registrar. The records and facilities of the deputy registrar
6.33 must at all times be open to the inspection of the registrar or
6.34 the registrar's agents. The deputy registrar shall report to
6.35 the registrar by the next working day following receipt all
6.36 registrations made and taxes and fees collected by the deputy
7.1 registrar. The filing fee imposed under subdivision 7 must be
7.2 deposited in the treasury of the place for which appointed or,
7.3 if not a public official, a deputy shall retain the filing fee,
7.4 but the registration tax and any additional fees for delayed
7.5 registration the deputy registrar has collected the deputy
7.6 registrar shall deposit by the next working day following
7.7 receipt in an approved state depository to the credit of the
7.8 state through the state treasurer. The place for which the
7.9 deputy registrar is appointed through its governing body must
7.10 provide the deputy registrar with facilities and personnel to
7.11 carry out the duties imposed by this subdivision if the deputy
7.12 is a public official. In all other cases, the deputy shall
7.13 maintain a suitable facility for serving the public.

10.24 during the reporting period, less the amount herein allowed to
10.25 be retained for expenses. The court administrators of the
10.26 district courts may appoint agents to assist in accepting
10.27 applications, but the administrators shall require every agent
10.28 to forward to the administrators by whom the agent is appointed
10.29 all applications accepted and fees collected by the agent,
10.30 except that an agent shall retain the county fee to cover the
10.31 agent's expenses involved in receiving, accepting or forwarding
10.32 the applications and fees. The court administrators shall be
10.33 responsible for the acts of agents appointed by them and for the
10.34 forwarding to the department of all applications accepted and
10.35 those fees collected by agents and by themselves as are required
10.36 to be forwarded to the department. The commissioner shall
11.1 suspend or revoke the appointment of a license agent or issue a
11.2 correction order to a license agent who violates any requirement
11.3 of this section or when grounds exist that would justify
11.4 revocation or suspension of a deputy registrar appointment under
11.5 Minnesota Rules, parts 7406.0800 to 7406.1000. To revoke or
11.6 suspend an appointment, the commissioner shall follow procedures
11.7 for suspension and revocation hearings set forth in Minnesota
 11.8 Rules, parts 7406.1100 to 7406.2600.
 11.9 Sec. 10. [171.061] [DRIVER'S LICENSE AGENTS.]
11.10 Subdivision 1. [DEFINITIONS.] For purposes of this section:
11.11 (1) "applicant" means an individual applying for a driver's
11.12 license, restricted license, duplicate license, instruction

 11.18 operator's permit.
11.19 Subd. 2. [APPOINTMENT AND DISCONTINUANCE.] (a) The
11.20 commissioner of public safety may appoint an individual, and for
11.21 cause discontinue the appointment of an agent, to serve as a
 11.22 driver's license agent.
11.23 (b) A county board may appoint an individual, and for cause
11.24 discontinue the appointment of an agent, to serve as an agent,
11.25 pursuant to sections 373.32 to 373.38, with the approval of the
11.26 commissioner. If a county board does not discontinue an agent's
11.27 appointment, although cause for discontinuance exists, the
11.28 commissioner may discontinue the appointment. If a county board
11.29 does not appoint an individual, the commissioner may establish
11.30 an office and appoint an individual to accept applications as
11.31 the public interest and convenience may require.
11.32 (c) The county board is responsible for the acts of an
11.33 agent appointed by the board and for forwarding to the
11.34 department all applications accepted and fees collected by the
11.35 agent as required by the department.
11.36 Subd. 3. [APPLICATIONS.] An applicant may file an
12.1 application with an agent. The agent shall receive and accept
12.2 applications in accordance with the laws and rules of the
12.3 department of public safety for a driver's license, restricted
12.4 license, duplicate license, instruction permit, Minnesota
12.5 identification card, or motorized bicycle operator's permit.
12.6 Subd. 4. [FEE; EQUIPMENT.] (a) The agent may charge and
12.7 retain a filing fee of $3.50 for each application. Except as
12.8 provided in paragraph (b), the fee shall cover all expenses
12.9 involved in receiving, accepting, or forwarding to the
12.10 department the applications and fees required under sections
 12.11 171.02, subdivision 3; 171.06, subdivisions 2 and 2a; and
 12.12 171.07, subdivisions 3 and 3a.
12.13 (b) An agent with photo identification equipment provided
12.14 by the department before January 1, 1999, may retain the photo
12.15 identification equipment until the agent's appointment
12.16 terminates. The department shall maintain the photo
12.17 identification equipment for these agents. An agent appointed
12.18 before January 1, 1999, who does not have photo identification
12.19 equipment provided by the department, and any new agent
12.20 appointed after December 31, 1998, shall procure and maintain
12.21 photo identification equipment. All photo identification
12.22 equipment must be compatible with standards established by the
 12.23 department.
12.24 (c) A filing fee retained by the agent employed by a county
12.25 board must be paid into the county treasury and credited to the
12.26 general revenue fund of the county. An agent who is not an
12.27 employee of the county shall retain the filing fee in lieu of
12.28 county employment or salary and is considered an independent
12.29 contractor for pension purposes, coverage under the Minnesota
12.30 state retirement system, or membership in the public employees
 12.31 retirement association.
12.32 (d) Before the end of the first working day following the
12.33 final day of the reporting period established by the department,
12.34 the agent must forward to the department all applications and
12.35 fees collected during the reporting period except as provided in
 12.36 paragraph (c).
13.1 Subd. 5. [DISCONTINUANCE OR TRANSFER OF APPOINTMENT.] (a)
13.2 An agent shall notify the department no less than 30 days before
 13.3 the discontinuance of service.
 13.4      (b) In the event of the notice specified in paragraph (a);
13.5 death or retirement of the agent; or revocation or
13.6 discontinuance of the appointment of the agent by the county
13.7 board or commissioner, the appointment terminates and all
13.8 equipment provided by the department reverts to the department.
13.9 Subd. 6. [RULES.] The commissioner shall adopt rules that
 13.10 prescribe:
13.11 (1) criteria, procedures, and requirements for appointing
 13.12  an individual as an agent of the commissioner;
13.13 (2) criteria for establishment, operation, management,
 13.14  location, and movement of a license application office;
13.15 (3) standards for the uniform administration of laws and
13.16 rules governing the receipt of applications and fees for
 13.17  applications;
 13.18     (4) number of applications to be processed;
13.19 (5) standards for submitting applications including valid
13.20 forms of identification, depositing funds, maintaining records,
13.21 and holding proper bonds; and
 13.22 (6) standards for discontinuing the individual's
13.23 appointment and for enforcement action.
 13.24 Sec. 11. Minnesota Statutes 1996, section 373.33, is
 13.25 amended to read:
13.26 373.33 [STATE LICENSES MAY BE ISSUED.]
13.27 A county license bureau may issue, process or assist in
13.28 preparing an application for any license or permit issued by the
13.29 state or a state official including but not limited to game and
13.30 fish, trapping, wild rice harvest, motor vehicle, manufactured
13.31 home, trailer, snowmobile, watercraft or drivers license or as
13.32 many of the licenses as designated by the county board. The
13.33 processing of driver's license applications by a county license
13.34 bureau is subject to the provisions of section 171.061. This
13.35 authority does not include the issuance of marriage licenses.
13.36 The county board may delegate the responsibility for the
14.1 issuance of any county license or permit to the county license
 14.2 bureau.
 14.3 Sec. 12. Minnesota Statutes 1996, section 373.35,
14.4 subdivision 1, is amended to read:
14.5 Subdivision 1. [AUDITOR OR BOARD APPOINTEE.] The county
14.6 auditor shall serve as the director of the county license bureau
14.7 or, if the auditor chooses not to serve, the county board shall
14.8 appoint any other county officer or employee, or any other
14.9 person, to serve as the director upon the terms and conditions
14.10 the county board deems advisable. The county board shall set
14.11 the compensation of the director and may provide for the
14.12 expenses of the office including the premium of any bond
14.13 required to be furnished by the director. The director shall
14.14 have the powers and duties imposed on the county officer who
14.15 previously had the authority to issue or process the application
14.16 for any license referred to in section 373.32.
 14.17 Notwithstanding section 168.33, subdivision 2, the
14.18 commissioner of public safety may appoint, and for cause
14.19 discontinue, the director as the deputy registrar of motor
14.20 vehicles in the county. If the director is a deputy registrar,
14.21 all provisions of section 168.33 and Minnesota Rules, chapter
14.22 7406, apply to a county license bureau. If the director is a

14.24 thereunder apply to the county license board director.
14.25 Sec. 13. [REAPPOINTMENT OF DRIVER'S LICENSE AGENTS.]
14.26 The appointment of a driver's license agent appointed
 14.27 before January 1, 1999, expires on January 1, 1999, unless the

14.29 reappointment to serve as an agent under Minnesota Statutes,
 14.30 section 171.061, subdivision 2, paragraph (a) or (c). The
14.31 commissioner shall reappoint any agent who applies under this
14.32 section unless the commissioner determines that the applicant's
14.33 performance as a driver's license agent would be grounds for
14.34 discontinuance as an agent under the rules adopted under
 14.35 Minnesota Statutes, section 171.061, subdivision 6, clause (6).
 14.36 Sec. 14. [TRANSITION.]

 15.12  operating in Dakota county;
15.13 (2) has operated for at least nine years the office at
15.14 which the applicant will carry out the functions of a driver's
