1.1 A bill for an act 1.2 relating to motor vehicles; making technical changes 1.3 to clarify that pickup truck with slip in camper may 1.4 be registered depending upon its weight; eliminating 1.5 authority for the appointment of corporations as 1.6 deputy registrars; restricting telephonic access to 1.7 certain information related to vehicle registration; 1.8 allowing vehicle dealers 21 days to send purchase 1.9 receipt to department of public safety if vehicle not 1.10 sold; providing for display of fleet vehicle license 1.11 plates; removing sunset date relating to recreational 1.12 vehicle combination length; providing for appointment, 1.13 duties, and discontinuance of appointment of driver's 1.14 license agents; requiring adoption of rules; amending 1.15 Minnesota Statutes 1996, sections 168.011, subdivision 1.16 25; 168.16; 168.33, subdivision 2; 168.345, 1.17 subdivision 1; 168A.11, subdivision 2; 169.79; 169.81, 1.18 subdivision 3c; 171.06, subdivision 4; 373.33; and 1.19 373.35, subdivision 1; proposing coding for new law in 1.20 Minnesota Statutes, chapter 171; repealing Minnesota 1.21 Statutes 1996, section 171.06, subdivision 4. 1.22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.23 Section 1. Minnesota Statutes 1996, section 168.011, 1.24 subdivision 25, is amended to read: 1.25 Subd. 25. [RECREATIONAL EQUIPMENT.] (a) "Recreational 1.26 equipment" means travel trailers including those which telescope 1.27 or fold down, chassis mounted campers, house cars, motor homes, 1.28 tent trailers, slip in campers, and converted buses that provide 1.29 temporary human living quarters. A vehicle is considered to 1.30 provide temporary living quarters if it: 1.31 (1) is not used as the residence of the owner or occupant; 1.32 (2) is used for temporary living quarters by the owner or 1.33 occupant while engaged in recreational or vacation activities; 2.1 and 2.2 (3) is self-propelled or towed on the public streets or 2.3 highways incidental to the recreational or vacation activities. 2.4 (b) For the purposes of this subdivision, a motor home 2.5 means a unit designed to provide temporary living quarters, 2.6 built into as an integral part of, or permanently attached to, a 2.7 self-propelled motor vehicle chassis or van. A motor home must 2.8 contain permanently installed independent life support systems 2.9 which meet the American National Standards Institute standard 2.10 number A119.2 for recreational vehicles and provide at least 2.11 four of the following facilities, two of which must be from the 2.12 systems listed in clauses (1), (5), and (6): (1) cooking 2.13 facility with liquid propane gas supply, (2) refrigerator, (3) 2.14 self-contained toilet or a toilet connected to a plumbing system 2.15 with connection for external water disposal, (4) heating or air 2.16 conditioning separate from the vehicle engine, (5) a potable 2.17 water supply system including a sink with faucet either 2.18 self-contained or with connections for an external source, and 2.19 (6) separate 110-125 volt electrical power supply. For purposes 2.20 of this subdivision, "permanently installed" means built into or 2.21 attached as an integral part of a chassis or van, and designed 2.22 not to be removed except for repair or replacement. A system 2.23 which is readily removable or held in place by clamps or tie 2.24 downs is not permanently installed. 2.25 (c) Motor homes include but are not limited to, the 2.26 following: 2.27 (1) Type A Motor Home -- a raw chassis upon which is built 2.28 a driver's compartment and an entire body that provides 2.29 temporary living quarters as defined in this paragraph; 2.30 (2) Type B Motor Home -- a van-type vehicle that conforms 2.31 to the motor home definition in this paragraph and has been 2.32 completed or altered by the final stage manufacturer; and 2.33 (3) Type C Motor Home -- an incomplete vehicle upon which 2.34 is permanently attached a body designed to provide temporary 2.35 living quarters as defined in this paragraph. 2.36(c)(d) Slip in campers are mounted into a vehicle commonly 3.1 known as a pickup truck, in the pickup box, either by bolting 3.2 through the floor of the pickup box or by firmly clamping to the 3.3 side of the pickup box. The vehiclemustmay not be registered 3.4 as apassenger automobilerecreational vehicle. 3.5 Sec. 2. Minnesota Statutes 1996, section 168.16, is 3.6 amended to read: 3.7 168.16 [REFUNDS; APPROPRIATION.] 3.8 After the tax upon any motor vehicle shall have been paid 3.9 for any year, refund shall be made for errors made in computing 3.10 the tax or fees and for the error on the part of an owner who 3.11 may in error have registered a motor vehicle that was not 3.12 before, nor at the time of registration, nor at any time 3.13 thereafter during the current past year, subject to tax in this 3.14 state as provided by section 168.012. Unless otherwise provided 3.15 in this chapter, a claim for a refund of an overpayment of 3.16 registration tax must be filed within 3-1/2 years from the date 3.17 of payment. The refundment shall be made from any fund in 3.18 possession of the registrar and shall be deducted from the 3.19 registrar's monthly report to the commissioner of finance. A 3.20 detailed report of the refundment shall accompany the report. 3.21 The former owner of a transferred vehicle by an assignment in 3.22 writing endorsed upon the registration certificate and delivered 3.23 to the registrar within the time provided herein may sell and 3.24 assign to the new owner thereof the right to have the tax paid 3.25 by the former owner accredited to the owner who duly registers 3.26 the vehicle. Any owner at the time of such occurrence, whose 3.27 vehicle is declared by an insurance company to be a total loss 3.28 due to flood damage, permanently destroyed, or sold to the 3.29 federal government, the state, or political subdivision thereof, 3.30 and any owner who sells a rental motor vehicle and transfers the 3.31 license plates issued to that motor vehicle under section 3.32 168.15, subdivision 3, shall upon filing a verified claim be 3.33 entitled to a refund of the unused portion of the tax paid upon 3.34 the vehicle, computed as follows: 3.35 (1) if the vehicle is registered under the calendar year 3.36 system of registration, the refund is computed pro rata by the 4.1 month, 1/12 of the annual tax paid for each month of the year 4.2 remaining after the month in which the plates and certificate 4.3 were returned to the registrar; 4.4 (2) in the case of a vehicle registered under the monthly 4.5 series system of registration, the amount of the refund is equal 4.6 to the sum of the amounts of the license fee attributable to 4.7 those months remaining in the licensing period after the month 4.8 in which the plates and certificate were returned to the 4.9 registrar. 4.10 There is hereby appropriated to the persons entitled to a 4.11 refund, from the fund or account in the state treasury to which 4.12 the money was credited, an amount sufficient to make the refund 4.13 and payment. Refunds under this section to licensed motor 4.14 vehicle lessors must be made annually in a manner the registrar 4.15 determines. 4.16 Sec. 3. Minnesota Statutes 1996, section 168.33, 4.17 subdivision 2, is amended to read: 4.18 Subd. 2. [POWERS REGARDING DEPUTY REGISTRARS.] The 4.19 registrar may appoint, hire, and discharge and fix the 4.20 compensation of the necessary employees, in the manner provided 4.21 by law, as may be required to enable the registrar to properly 4.22 carry out the duties imposed by this chapter. The registrar may 4.23 appoint, and for cause discontinue, a deputy registrar for any 4.24 statutory or home rule charter city as the public interest and 4.25 convenience may require, without regard to whether the county 4.26 auditor of the county in which the city is situated has been 4.27 appointed as the deputy registrar for the county or has been 4.28 discontinued as the deputy registrar for the county, and without 4.29 regard to whether the county in which the city is situated has 4.30 established a county license bureau which issues motor vehicle 4.31 licenses as provided in section 373.32. 4.32 The registrar may appoint, and for cause discontinue, a 4.33 deputy registrar for any statutory or home rule charter city as 4.34 the public interest and convenience may require, if the auditor 4.35 for the county in which the city is situated chooses not to 4.36 accept appointment as the deputy registrar for the county or is 5.1 discontinued as a deputy registrar, or if the county in which 5.2 the city is situated has not established a county license bureau 5.3 which issues motor vehicle licenses as provided in section 5.4 373.32. A person appointed by the registrar as a deputy 5.5 registrar for any statutory or home rule charter city must be a 5.6 resident of the county in which the city is situated. 5.7 The registrar may appoint, and for cause discontinue, the 5.8 county auditor of each county as a deputy registrar. Upon 5.9 approval of the county board, the auditor, with the approval of 5.10 the director of motor vehicles, may appoint, and for cause 5.11 discontinue, the clerk or equivalent officer of each statutory 5.12 or home rule charter city or any other person as a deputy 5.13 registrar as public interest and convenience may require, 5.14 regardless of the appointee's county of residence. At the 5.15 request of the governing body of a statutory or home rule 5.16 charter city, the auditor shall appoint, and may for cause 5.17 discontinue, the clerk or equivalent officer of a city, or 5.18 another officer or employee of the city designated by the 5.19 governing body, as a deputy registrar: 5.20 (1) if the city is a county seat or, if not, is larger than 5.21 the seat of the county in which it is situated; and 5.22 (2) no office of a deputy registrar is situated within the 5.23 city or within 15 miles of the city by the most direct public 5.24 route. 5.25 Notwithstanding any other provision, a person other than a 5.26 county auditor or a director of a county license bureau, who was 5.27 appointed by the registrar before August 1, 1976, as a deputy 5.28 registrar for any statutory or home rule charter city, may 5.29 continue to serve as deputy registrar and may be discontinued 5.30 for cause only by the registrar. The county auditor who 5.31 appointed the deputy registrars is responsible for the acts of 5.32 deputy registrars appointed by the auditor. Each deputy, before 5.33 entering upon the discharge of duties, shall take and subscribe 5.34 an oath to faithfully discharge the duties and to uphold the 5.35 laws of the state. If a deputy registrar appointed under this 5.36 subdivision is not an officer or employee of a county or 6.1 statutory or home rule charter city, the deputy shall in 6.2 addition give bond to the state in the sum of $10,000, or a 6.3 larger sum as may be required by the registrar, conditioned upon 6.4 the faithful discharge of duties as deputy registrar.A6.5corporation governed by chapter 302A may be appointed a deputy6.6registrar. Upon application by an individual serving as a6.7deputy registrar and the giving of the requisite bond as6.8provided in this subdivision, personally assured by the6.9individual or another individual approved by the commissioner of6.10public safety, a corporation named in an application shall6.11become the duly appointed and qualified successor to the deputy6.12registrar.A deputy registrar may incorporate for business 6.13 purposes, but an appointment as deputy registrar must be vested 6.14 in an individual and not in the corporation. Each deputy 6.15 registrar appointed under this subdivision shall keep and 6.16 maintain, in a convenient public place within or in close 6.17 proximity to the place for which appointed, a registration and 6.18 motor vehicle tax collection bureau, to be approved by the 6.19 registrar, for the registration of motor vehicles and the 6.20 collection of taxes on motor vehicles. The deputy registrar 6.21 shall keep records and make reports to the registrar as the 6.22 registrar, from time to time, may require. The records must be 6.23 maintained at the facility of the deputy registrar. The records 6.24 and facilities of the deputy registrar must at all times be open 6.25 to the inspection of the registrar or the registrar's agents. 6.26 The deputy registrar shall report to the registrar by the next 6.27 working day following receipt all registrations made and taxes 6.28 and fees collected by the deputy registrar. The filing fee 6.29 imposed under subdivision 7 must be deposited in the treasury of 6.30 the place for which appointed or, if not a public official, a 6.31 deputy shall retain the filing fee, but the registration tax and 6.32 any additional fees for delayed registration the deputy 6.33 registrar has collected the deputy registrar shall deposit by 6.34 the next working day following receipt in an approved state 6.35 depository to the credit of the state through the state 6.36 treasurer. The place for which the deputy registrar is 7.1 appointed through its governing body must provide the deputy 7.2 registrar with facilities and personnel to carry out the duties 7.3 imposed by this subdivision if the deputy is a public official. 7.4 In all other cases, the deputy shall maintain a suitable 7.5 facility for serving the public. 7.6 Sec. 4. Minnesota Statutes 1996, section 168.345, 7.7 subdivision 1, is amended to read: 7.8 Subdivision 1. [TELEPHONE INFORMATION.] Information 7.9 concerning motor vehicle registrations shall not be furnished on 7.10 the telephone to any person except the personnel of law 7.11 enforcement agencies and the personnel offederal, state, and7.12localgovernmentalunitsmotor vehicle and registration offices. 7.13 Sec. 5. Minnesota Statutes 1996, section 168A.11, 7.14 subdivision 2, is amended to read: 7.15 Subd. 2. [PURCHASE RECEIPT.] A dealer, on buying a vehicle 7.16which is subject to an outstandingfor which the seller does not 7.17 present a certificate of title, shall at the time of taking 7.18 delivery of the vehicle execute in triplicate a purchase receipt 7.19 for the vehicle in a form designated by the department, and 7.20 deliver one copy to the seller.Within 48 hours thereafterWhen 7.21 a vehicle purchased by a dealer has not been resold after 21 7.22 days, the dealer shall mail, transmit, or deliver one copy 7.23 ofsuchthe receipt to the department. 7.24 Sec. 6. Minnesota Statutes 1996, section 169.79, is 7.25 amended to read: 7.26 169.79 [VEHICLE REGISTRATION.] 7.27 No person shall operate, drive or park a motor vehicle on 7.28 any highway unless the vehicle is registered in accordance with 7.29 the laws of this state and has the number plates for the current 7.30 year only, except as provided in section 168.12, subdivision 2f, 7.31 as assigned to it by the commissioner of public safety, 7.32 conspicuously displayed thereon in a manner that the view of any 7.33 plate is not obstructed. If the vehicle is a semitrailer, the 7.34 number plate displayed must be assigned to the registered owner 7.35 and correlate to the certificate of title documentation on file 7.36 with the department and shall not display a year indicator. If 8.1 the vehicle is a motorcycle, motor scooter, motorized bicycle, 8.2 motorcycle sidecar, trailer, semitrailer, or vehicle displaying 8.3 a dealer plate, one plate shall be displayed on the rear 8.4 thereof; if the vehicle is a truck-tractor, road-tractor or farm 8.5 truck, as defined in section 168.011, subdivision 17, but 8.6 excluding from that definition semitrailers and trailers, one 8.7 plate shall be displayed on the front thereof; if it is any 8.8 other kind of motor vehicle, one plate shall be displayed on the 8.9 front and one on the rear thereof. All plates shall be securely 8.10 fastened so as to prevent them from swinging. The person 8.11 driving the motor vehicle shall keep the plate legible and 8.12 unobstructed and free from grease, dust, or other blurring 8.13 material so that the lettering shall be plainly visible at all 8.14 times. It is unlawful to cover any assigned letters and numbers 8.15 or the name of the state of origin of a license plate with any 8.16 material whatever, including any clear or colorless material 8.17 that affects the plate's visibility or reflectivity. License 8.18 plates issued to vehicles registered under section 168.017 must 8.19 display the month of expiration in the lower left corner as 8.20 viewed facing the plate and the year of expiration in the lower 8.21 right corner as viewed facing the plate. License plates issued 8.22 to vehicles registered under section 168.127 must display either 8.23 fleet registration validation stickers in the lower right corner 8.24 as viewed facing the plates or distinctive license plates, 8.25 issued by the registrar, with "FLEET REG" embossed on the bottom 8.26 center portion of the plate. 8.27 Sec. 7. Minnesota Statutes 1996, section 169.81, 8.28 subdivision 3c, is amended to read: 8.29 Subd. 3c. [RECREATIONAL VEHICLE COMBINATIONS.] 8.30 Notwithstanding subdivision 3, a recreational vehicle 8.31 combination may be operated without a permit if: 8.32 (1) the combination does not consist of more than three 8.33 vehicles, and the towing rating of the pickup truck is equal to 8.34 or greater than the total weight of all vehicles being towed; 8.35 (2) the combination does not exceed 60 feet in length; 8.36 (3) the camper-semitrailer in the combination does not 9.1 exceed 28 feet in lengthuntil August 1, 1997, and 26 feet9.2thereafter; 9.3 (4) the operator of the combination is at least 18 years of 9.4 age; 9.5 (5) the trailer carrying a watercraft meets all 9.6 requirements of law; 9.7 (6) the trailers in the combination are connected to the 9.8 pickup truck and each other in conformity with section 169.82; 9.9 and 9.10 (7) the combination is not operated within the seven-county 9.11 metropolitan area, as defined in section 473.121, subdivision 2, 9.12 during the hours of 6:00 a.m. to 9:00 a.m. and 4:00 p.m. to 7:00 9.13 p.m. on Mondays through Fridays. 9.14 Sec. 8. Minnesota Statutes 1996, section 171.06, 9.15 subdivision 4, is amended to read: 9.16 Subd. 4. [APPLICATION, FILING; FEE RETAINED FOR EXPENSES.] 9.17 Any applicant for an instruction permit, a driver's license, 9.18 restricted license, or duplicate license may file an application 9.19 with a court administrator of the district court or at a state 9.20 office. The administrator or state office shall receive and 9.21 accept the application. To cover all expenses involved in 9.22 receiving, accepting, or forwarding to the department 9.23 applications and fees, the court administrator of the district 9.24 court may retain a county fee of $3.50 for each application for 9.25 a Minnesota identification card, instruction permit, duplicate 9.26 license, driver license, or restricted license. The amount 9.27 allowed to be retained by the court administrator of the 9.28 district court shall be paid into the county treasury and 9.29 credited to the general revenue fund of the county. Before the 9.30 end of the first working day following the final day of an 9.31 established reporting period, the court administrator shall 9.32 forward to the department all applications and fees collected 9.33 during the reporting period, less the amount herein allowed to 9.34 be retained for expenses. The court administrators of the 9.35 district courts may appoint agents to assist in accepting 9.36 applications, but the administrators shall require every agent 10.1 to forward to the administrators by whom the agent is appointed 10.2 all applications accepted and fees collected by the agent, 10.3 except that an agent shall retain the county fee to cover the 10.4 agent's expenses involved in receiving, accepting or forwarding 10.5 the applications and fees. The court administrators shall be 10.6 responsible for the acts of agents appointed by them and for the 10.7 forwarding to the department of all applications accepted and 10.8 those fees collected by agents and by themselves as are required 10.9 to be forwarded to the department. The commissioner shall 10.10 suspend or revoke the appointment of a license agent or issue a 10.11 correction order to a license agent who violates any requirement 10.12 of this section or when grounds exist that would justify 10.13 revocation or suspension of a deputy registrar appointment under 10.14 Minnesota Rules, parts 7406.0800 to 7406.1000. To revoke or 10.15 suspend an appointment, the commissioner shall follow procedures 10.16 for suspension and revocation hearings set forth in Minnesota 10.17 Rules, parts 7406.1100 to 7406.2600. 10.18 Sec. 9. [171.061] [DRIVER'S LICENSE AGENTS.] 10.19 Subdivision 1. [DEFINITIONS.] For purposes of this section: 10.20 (1) "applicant" means an individual applying for a driver's 10.21 license, restricted license, duplicate license, instruction 10.22 permit, Minnesota identification card, or motorized bicycle 10.23 operator's permit; and 10.24 (2) "application" refers to an application for a driver's 10.25 license, restricted license, duplicate license, instruction 10.26 permit, Minnesota identification card, or motorized bicycle 10.27 operator's permit. 10.28 Subd. 2. [APPOINTMENT AND DISCONTINUANCE.] (a) The 10.29 commissioner of public safety may appoint an individual, and for 10.30 cause discontinue the appointment of an agent, to serve as a 10.31 driver's license agent. 10.32 (b) A county board may appoint an individual, and for cause 10.33 discontinue the appointment of an agent, to serve as an agent, 10.34 pursuant to sections 373.32 to 373.38, with the approval of the 10.35 commissioner. If a county board does not discontinue an agent's 10.36 appointment, although cause for discontinuance exists, the 11.1 commissioner may discontinue the appointment. If a county board 11.2 does not appoint an individual, the commissioner may establish 11.3 an office and appoint an individual to accept applications as 11.4 the public interest and convenience may require. 11.5 (c) The county board is responsible for the acts of an 11.6 agent appointed by the board and for forwarding to the 11.7 department all applications accepted and fees collected by the 11.8 agent as required by the department. 11.9 (d) An agent may incorporate for business purposes, but an 11.10 appointment as agent must be vested in an individual and not in 11.11 the corporation. 11.12 Subd. 3. [APPLICATIONS.] An applicant may file an 11.13 application with an agent. The agent shall receive and accept 11.14 applications in accordance with the laws and rules of the 11.15 department of public safety for a driver's license, restricted 11.16 license, duplicate license, instruction permit, Minnesota 11.17 identification card, or motorized bicycle operator's permit. 11.18 Subd. 4. [FEE; EQUIPMENT.] (a) The agent may charge and 11.19 retain a filing fee of $3.50 for each application. Except as 11.20 provided in paragraph (b), the fee shall cover all expenses 11.21 involved in receiving, accepting, or forwarding to the 11.22 department the applications and fees required under sections 11.23 171.02, subdivision 3; 171.06, subdivisions 2 and 2a; and 11.24 171.07, subdivisions 3 and 3a. 11.25 (b) An agent with photo identification equipment provided 11.26 by the department before January 1, 1999, may retain the photo 11.27 identification equipment until the agent's appointment 11.28 terminates. The department shall maintain the photo 11.29 identification equipment for these agents. An agent appointed 11.30 before January 1, 1999, who does not have photo identification 11.31 equipment provided by the department, and any new agent 11.32 appointed after December 31, 1998, shall procure and maintain 11.33 photo identification equipment. All photo identification 11.34 equipment must be compatible with standards established by the 11.35 department. 11.36 (c) A filing fee retained by the agent employed by a county 12.1 board must be paid into the county treasury and credited to the 12.2 general revenue fund of the county. An agent who is not an 12.3 employee of the county shall retain the filing fee in lieu of 12.4 county employment or salary and is considered an independent 12.5 contractor for pension purposes, coverage under the Minnesota 12.6 state retirement system, or membership in the public employees 12.7 retirement association. 12.8 (d) Before the end of the first working day following the 12.9 final day of the reporting period established by the department, 12.10 the agent must forward to the department all applications and 12.11 fees collected during the reporting period except as provided in 12.12 paragraph (c). 12.13 Subd. 5. [DISCONTINUANCE OR TRANSFER OF APPOINTMENT.] (a) 12.14 An agent shall notify the department no less than 30 days before 12.15 the discontinuance of service. 12.16 (b) In the event of the notice specified in paragraph (a); 12.17 death or retirement of the agent; or revocation or 12.18 discontinuance of the appointment of the agent by the county 12.19 board or commissioner, the appointment terminates and all 12.20 equipment provided by the department reverts to the department. 12.21 (c) An agent may not sell or transfer the agent's 12.22 appointment and any equipment provided by the department. 12.23 Subd. 6. [RULES.] The commissioner shall adopt rules that 12.24 prescribe: 12.25 (1) criteria, procedures, and requirements for appointing 12.26 an individual as an agent of the commissioner; 12.27 (2) criteria for establishment, operation, management, 12.28 location, and movement of a license application office; 12.29 (3) standards for the uniform administration of laws and 12.30 rules governing the receipt of applications and fees for 12.31 applications; 12.32 (4) number of applications to be processed; 12.33 (5) standards for submitting applications including valid 12.34 forms of identification, depositing funds, maintaining records, 12.35 and holding proper bonds; and 12.36 (6) standards for discontinuing the individual's 13.1 appointment and for enforcement action. 13.2 Sec. 10. Minnesota Statutes 1996, section 373.33, is 13.3 amended to read: 13.4 373.33 [STATE LICENSES MAY BE ISSUED.] 13.5 A county license bureau may issue, process or assist in 13.6 preparing an application for any license or permit issued by the 13.7 state or a state official including but not limited to game and 13.8 fish, trapping, wild rice harvest, motor vehicle, manufactured 13.9 home, trailer, snowmobile, watercraft or drivers license or as 13.10 many of the licenses as designated by the county board. The 13.11 processing of driver's license applications by a county license 13.12 bureau is subject to the provisions of section 171.061. This 13.13 authority does not include the issuance of marriage licenses. 13.14 The county board may delegate the responsibility for the 13.15 issuance of any county license or permit to the county license 13.16 bureau. 13.17 Sec. 11. Minnesota Statutes 1996, section 373.35, 13.18 subdivision 1, is amended to read: 13.19 Subdivision 1. [AUDITOR OR BOARD APPOINTEE.] The county 13.20 auditor shall serve as the director of the county license bureau 13.21 or, if the auditor chooses not to serve, the county board shall 13.22 appoint any other county officer or employee, or any other 13.23 person, to serve as the director upon the terms and conditions 13.24 the county board deems advisable. The county board shall set 13.25 the compensation of the director and may provide for the 13.26 expenses of the office including the premium of any bond 13.27 required to be furnished by the director. The director shall 13.28 have the powers and duties imposed on the county officer who 13.29 previously had the authority to issue or process the application 13.30 for any license referred to in section 373.32. 13.31 Notwithstanding section 168.33, subdivision 2, the 13.32 commissioner of public safety may appoint, and for cause 13.33 discontinue, the director as the deputy registrar of motor 13.34 vehicles in the county. If the director is a deputy registrar, 13.35 all provisions of section 168.33 and Minnesota Rules, chapter 13.36 7406, apply to a county license bureau. If the director is a 14.1 driver's license agent, section 171.061 and rules promulgated 14.2 thereunder apply to the county license board director. 14.3 Sec. 12. [REAPPOINTMENT OF DRIVER'S LICENSE AGENTS.] 14.4 The appointment of a driver's license agent before January 14.5 1, 1999, expires on January 1, 1999, unless the agent applies to 14.6 the commissioner before January 1, 1999, for reappointment to 14.7 serve as an agent under Minnesota Statutes, section 171.061, 14.8 subdivision 2, paragraph (a) or (c). The commissioner shall 14.9 reappoint all applicants described in this section, who must 14.10 comply with the provisions of Minnesota Statutes, section 14.11 171.061, and rules adopted thereunder. 14.12 Sec. 13. [TRANSITION.] 14.13 The court administrators of the district courts may not 14.14 appoint an agent before January 1, 1999, under Minnesota 14.15 Statutes, section 171.06, other than an agent appointed to 14.16 replace or succeed an already existing agent. 14.17 Sec. 14. [APPOINTMENT BY THE COMMISSIONER.] 14.18 Notwithstanding the effective date of section 9, 14.19 subdivisions 1 to 4, the commissioner shall appoint an applicant 14.20 that is an individual or corporation, and may for cause 14.21 discontinue the appointment of an agent, as a driver's license 14.22 agent if the applicant: 14.23 (1) is a deputy registrar who is not a public official 14.24 operating in Dakota county; 14.25 (2) has operated for at least nine years the office at 14.26 which the applicant will carry out the functions of a driver's 14.27 license agent; and 14.28 (3) procures and maintains photo identification equipment 14.29 satisfactory to the commissioner. 14.30 An agent appointed under this section is subject to section 12. 14.31 Sec. 15. [TRANSFER OF APPOINTMENTS.] 14.32 A deputy registrar may not sell or transfer the deputy's 14.33 appointment. If an appointment as deputy registrar is held by a 14.34 corporation on the effective date of this section, an officer or 14.35 director of the corporation, or a person designated by an 14.36 officer or director, must apply to the registrar for a transfer 15.1 of the appointment to the applicant. The application must be 15.2 received by the registrar by December 31, 1997. 15.3 Sec. 16. [REPEALER.] 15.4 Minnesota Statutes 1996, section 171.06, subdivision 4, is 15.5 repealed. 15.6 Sec. 17. [EFFECTIVE DATE.] 15.7 Section 9, subdivisions 5 and 6, and sections 12, 13, and 15.8 14 are effective the day following final enactment. Section 3 15.9 is effective the day following final enactment and applies to 15.10 appointments made after that date. Section 15 is effective the 15.11 day following final enactment. Sections 8 and 9, subdivisions 1 15.12 to 4, and sections 10, 11, and 16 are effective January 1, 1999.
