  1.1                          A bill for an act 
  1.2             relating to the State Lottery; amending provisions 
  1.3             relating to the director; creating a task force and 
  1.4             requiring a report; amending Minnesota Statutes 2002, 
  1.5             section 349A.02, subdivision 1; repealing Minnesota 
  1.6             Statutes 2002, section 349A.02, subdivision 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 349A.02, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DIRECTOR.] A State Lottery is established 
  1.11  under the supervision and control of a director.  The director 
  1.12  of the State Lottery shall be appointed by the governor with the 
  1.13  advice and consent of the senate.  The director must be 
  1.14  qualified by experience and training in the operation of a 
  1.15  lottery to supervise the lottery.  The director serves in the 
  1.16  unclassified service at the pleasure of the governor.  The 
  1.17  annual salary rate authorized for the director is equal to 95 
  1.18  percent of the salary rate prescribed for the governor. 
  1.19     Sec. 2.  [LOTTERY ORGANIZATION TASK FORCE.] 
  1.20     Subdivision 1.  [CREATION; MEMBERSHIP.] A Lottery 
  1.21  Organization Task Force is created to study and make 
  1.22  recommendations regarding the future organization of the State 
  1.23  Lottery.  The task force is composed of nine members, to be 
  1.24  appointed as follows: 
  1.25     (1) the commissioner of natural resources, or the 
  1.26  commissioner's designee; 
  2.1      (2) the commissioner of finance, or the commissioner's 
  2.2   designee; 
  2.3      (3) two members of the house of representatives, one to be 
  2.4   appointed by the speaker and one to be appointed by the minority 
  2.5   leader; 
  2.6      (4) two members of the senate, one to be appointed by the 
  2.7   senate majority leader and one to be appointed by the minority 
  2.8   leader; 
  2.9      (5) the director of the State Lottery; and 
  2.10     (6) two members to be appointed by the governor. 
  2.11     The governor shall appoint one member of the task force as 
  2.12  the chair. 
  2.13     Subd. 2.  [CHARGE; REPORT.] The task force shall examine 
  2.14  the State Lottery and consider whether the State Lottery should: 
  2.15     (1) become part of another existing state agency; 
  2.16     (2) be accountable to an oversight board or commission to 
  2.17  be created for that purpose; 
  2.18     (3) continue under its current organizational structure; or 
  2.19     (4) operate under other governance structures that provide 
  2.20  appropriate oversight and accountability. 
  2.21     The task force shall consult with the commissioner of 
  2.22  public safety, the commissioner of revenue, and the chair of the 
  2.23  Citizens' Advisory Committee for the Legislative Commission on 
  2.24  Minnesota Resources.  The task force shall submit a report with 
  2.25  its findings and recommendations to the legislature and the 
  2.26  governor by February 1, 2005. 
  2.27     Subd. 3.  [SUNSET.] The task force expires upon the 
  2.28  adjournment of the 2005 regular legislative session. 
  2.29     Sec. 3.  [REPEALER.] 
  2.30     Minnesota Statutes 2002, section 349A.02, subdivision 2, is 
  2.31  repealed. 
  2.32     Sec. 4.  [EFFECTIVE DATE.] 
  2.33     This act is effective the day following final enactment.  
  2.34  Sections 1 and 3 apply to the appointment of a director of the 
  2.35  State Lottery made on or after January 1, 2004.
