  1.1                          A bill for an act 
  1.2             relating to the State Lottery; amending provisions 
  1.3             relating to the director; providing for review and 
  1.4             approval of lottery budget; creating a task force and 
  1.5             requiring a report; providing for allocation and 
  1.6             transfer of certain unclaimed prize money; amending 
  1.7             Minnesota Statutes 2002, sections 349A.02, subdivision 
  1.8             1; 349A.10, subdivision 6; 349A.15; repealing 
  1.9             Minnesota Statutes 2002, section 349A.02, subdivision 
  1.10            2. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 2002, section 349A.02, 
  1.13  subdivision 1, is amended to read: 
  1.14     Subdivision 1.  [DIRECTOR.] A State Lottery is established 
  1.15  under the supervision and control of a director.  The director 
  1.16  of the State Lottery shall be appointed by the governor with the 
  1.17  advice and consent of the senate.  The director must be 
  1.18  qualified by experience and training in the operation of a 
  1.19  lottery to supervise the lottery.  The director serves in the 
  1.20  unclassified service at the pleasure of the governor.  The 
  1.21  annual salary rate authorized for the director is equal to 95 
  1.22  percent of the salary rate prescribed for the governor. 
  1.23     Sec. 2.  Minnesota Statutes 2002, section 349A.10, 
  1.24  subdivision 6, is amended to read: 
  1.25     Subd. 6.  [BUDGET APPEARANCE; PLANS.] The director shall 
  1.26  prepare and submit a budget in compliance with the rules, 
  1.27  format, and instructions established by the commissioner of 
  1.28  finance under sections 16A.095 and 16A.10.  The governor shall 
  2.1   recommend a budget for the lottery in the budget the governor 
  2.2   submits to the legislature under section 16A.11.  The amount 
  2.3   available to the lottery for operating expenses and capital 
  2.4   expenditures shall be determined by law.  In addition, the 
  2.5   director shall appear at least once each fiscal year before the 
  2.6   senate and house of representatives committees having 
  2.7   jurisdiction over gambling policy to present and explain the 
  2.8   lottery's budget plans for future games and the related 
  2.9   advertising and promotional campaigns and spending plans for the 
  2.10  next fiscal year. 
  2.11     Sec. 3.  Minnesota Statutes 2002, section 349A.15, is 
  2.12  amended to read: 
  2.13     349A.15 [REPORT.] 
  2.14     The director shall file an annual report with the governor 
  2.15  and legislature which must include a complete statement of 
  2.16  lottery revenues, administrative and operating costs, capital 
  2.17  expenditures, net proceeds transferred, and other financial 
  2.18  transactions for the period the report covers. 
  2.19     Sec. 4.  [LOTTERY ORGANIZATION TASK FORCE.] 
  2.20     Subdivision 1.  [CREATION; MEMBERSHIP.] A Lottery 
  2.21  Organization Task Force is created to study and make 
  2.22  recommendations regarding the future organization of the State 
  2.23  Lottery.  The task force is composed of seven members, to be 
  2.24  appointed as follows: 
  2.25     (1) the commissioner of natural resources, or the 
  2.26  commissioner's designee; 
  2.27     (2) the commissioner of finance, or the commissioner's 
  2.28  designee; 
  2.29     (3) one member of the house of representatives, to be 
  2.30  appointed by the speaker; 
  2.31     (4) one member of the senate, to be appointed by the senate 
  2.32  majority leader; 
  2.33     (5) the director of the State Lottery; and 
  2.34     (6) two members to be appointed by the governor. 
  2.35     Subd. 2.  [CHARGE; REPORT.] The task force shall examine 
  2.36  the State Lottery and consider whether the State Lottery should: 
  3.1      (1) become part of another existing state agency; 
  3.2      (2) be accountable to an oversight board or commission to 
  3.3   be created for that purpose; 
  3.4      (3) continue under its current organizational structure; or 
  3.5      (4) operate under other governance structures that provide 
  3.6   appropriate oversight and accountability. 
  3.7      The task force shall submit a report with its findings and 
  3.8   recommendations to the legislature and the governor by February 
  3.9   1, 2005. 
  3.10     Subd. 3.  [SUNSET.] The task force expires upon the 
  3.11  adjournment of the 2005 regular legislative session. 
  3.12     Sec. 5.  [UNCLAIMED PRIZE MONEY; TRANSFER.] 
  3.13     The director of the State Lottery, in consultation with the 
  3.14  commissioner of finance, shall determine how much money is still 
  3.15  available of the prize money that was considered unclaimed under 
  3.16  Minnesota Statutes, section 349A.08, subdivision 5, and that was 
  3.17  not committed to the prize of a lottery game under that section 
  3.18  before the 2004 fiscal year.  The director of the State Lottery 
  3.19  shall transfer all available prize money to the State Treasury, 
  3.20  to be credited as follows:  40 percent to the Minnesota 
  3.21  environment and natural resources trust fund and 60 percent to 
  3.22  the general fund. 
  3.23     Sec. 6.  [REPEALER.] 
  3.24     Minnesota Statutes 2002, section 349A.02, subdivision 2, is 
  3.25  repealed. 
  3.26     Sec. 7.  [EFFECTIVE DATE.] 
  3.27     This act is effective the day following final enactment.  
  3.28  Sections 1 and 6 apply to the appointment of a director of the 
  3.29  State Lottery made on or after January 1, 2004.
