1.1 A bill for an act 1.2 relating to environment; regulating ash disposal from 1.3 fire training exercises; amending Minnesota Statutes 1.4 2000, section 116.07, by adding a subdivision. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2000, section 116.07, is 1.7 amended by adding a subdivision to read: 1.8 Subd. 12. [FIRE TRAINING ASH DISPOSAL.] The ash from a 1.9 legitimate fire training exercise involving the live burning of 1.10 a structure must be classified as demolition debris and is 1.11 disposable in any permit-by-rule land disposal facility 1.12 authorized under agency rules or any permitted demolition land 1.13 disposal facility, with the consent of the disposal facility 1.14 operator, if a person certified by a Minnesota state colleges 1.15 and universities fire safety center certifies in writing in 1.16 advance to the commissioner that the structure has been 1.17 adequately prepared for such a training exercise, taking into 1.18 account all applicable safety concerns and regulations, 1.19 including pollution control agency guidelines regarding the 1.20 removal of hazardous materials from training-burn structures 1.21 before the training event. 1.22 Before the exercise, the authority conducting the exercise 1.23 must advise the property owner that a soil test is advisable if 1.24 the property will be used for growing food or for children's 1.25 recreation. 2.1 Sec. 2. [EFFECTIVE DATE.] 2.2 Section 1 is effective the day following final enactment.
