4E Relating to transportation

ARTICLE 1 - TRANSPORTATION POLICY

Modifying or
adding provisions to highways, motor vehicles, vehicle registration, fuel tax
agreement fees, traffic regulations and surcharges, vehicle parking ordinances,
commercial vehicles and vehicles combinations and permits, design build
construction, pupil transportation and school bus drivers, drivers licenses,
driver training, motor fuels, the state patrol, transit and paratransit
planning, urban partnership agreement implementation, the transfer of right of
way to state rail bank, nonmotorized transportation, transportation finance, and
other transportation related programs or practices; repealing surcharge for
special veteran license plates; requiring studies and reports; classifying data
for design build transportation project audio recordings of meetings with
proposers; authorizing the commissioner of transportation (DOT) to charge user
fees to single occupant motor vehicle (automobile) operators or owners using
certain designated dynamic shoulder lanes high-occupancy vehicle (HOV) lanes;
requiring consultation with the metropolitan council; establishing an I-35W HOV
and dynamic shoulder lane account and prescribing uses, specifying certain
corridor noise mitigation plan requirements by the commissioner and the
metropolitan council; allowing the commissioner to designate freeway dynamic
shoulder lanes; requiring a report to the legislature and annually on the urban
partnership agreement; exempting certain two wheel motorized vehicles from
wheelage taxes imposed by counties within the metropolitan area; requiring
medium speed electric vehicles to be registered and titled, identifying roads
medium speed electric vehicles may operate; requiring compensation for certain
technical review committee members; modifying provisions relating to design
build requests for proposals, scoring, project awards and protests; requiring
disclosure of reasons for change in stipulated fee; requiring rejection of
nonresponsive proposals by the technical review committee; requiring
commissioner consideration of certain insurance standards when reviewing data
and information for the development of safety improvements for trunk highways
and state aid projects; modifying the definitions of passenger automobile,
special mobile equipment and commercial motor vehicle; reclassifying certain
trucks and vans for motor vehicle registration purposes; defining spotter trucks
and regulating use; modifying registration and use of special mobile equipment;
requiring the commissioner in cooperation with the metropolitan council to study
possible adoption of a complete streets policy, requiring report to legislature;
requiring the display of license plates on concrete pumps and street sweeping
vehicles and specifying tax on nonregistered vehicles; permitting sale of
impounded vehicles and contents after voluntary title transfer; providing for
written notice of impound, right to reclaim contents, and waiver of rights;
establishing right to retrieve contents without charge in certain cases;
providing for auction or sale of contents of an abandoned or unauthorized
vehicle under certain conditions; limiting impound lot operator deficiency
claims; providing for permit for oversize and overweight tow trucks in certain
cases; exempting nonprofit disaster response vehicles from the motor vehicle
sales tax and registration fees; authorizing certain state hospitals and
institutions for persons who are mentally ill and developmentally disabled and
county social service agencies providing child and vulnerable adult protection
services to operate vehicles exempt from payment of registration tax and fees
and without the required identification on the sides of the vehicle; regulating
display of vehicle license plates; requiring vehicles displaying tax exempt
plates to have vehicle identification markings; allowing issuance of multiple
sets of motor vehicle license plates for physically disabled persons upon
approval of the state board on disability; allowing use of a temporary permit
while awaiting delivery of license plates and eliminating the use of special
plates; authorizing the design of special bronze star veterans and silver star
veterans motor vehicle license plates by the commissioner of veterans affairs;
establishing sesquicentennial special motor vehicle license plates and American
Red Cross special license plates; modifying the USDOT number registration
process and use for certain trucks and truck-tractors and clarifying certain
exemptions; reallocating proceeds from fuel license and decal fees collected
since 2005 under the international fuel tax agreement compact to the vehicles
services operating account in the special revenue fund; modifying certain school
bus definitions and drivers license requirements; modifying the definition of
implement of husbandry (farm vehicles); providing for certain size, weight, and
load restrictions; specifying certain operation requirements and modifying
driving exceptions for driving left of roadway center; conforming hazardous
materials and school bus endorsement provisions to the federal definition;
providing an operator drivers license exemption for commercial motor vehicles
operated on behalf of the federal government; specifying certain notification
requirements; requiring motor vehicle commercial operators to notify the
department of public safety division of driver and vehicle services of
convictions in conformance with federal regulation; requiring notification to
employer of conviction for violation and license suspension for violations;
making motor carrier out of service orders conform to federal regulation for
enforcement purposes; making monetary penalties for railroad-highway grade
crossings of motor carrier violations conform to federal law; conforming state
trooper law enforcement powers and duties to federal regulation regarding
uniform out of service criteria; requiring the commissioner of public safety to
include pupil transportation safety laws in the drivers manual and license
examination; providing certain minimum requirements for cities enacting
ordinances for a long term disability parking permit program; modifying brake
requirements for trailers or semitrailers and modifying certain gross vehicle
weight restrictions; modifying certain truck weight enforcement operation
requirements and modifying the gross vehicle weight requirement; modifying
weight restrictions for heating fuel vehicles; modifying the sale authority for
nonoxygenated gasoline for resorts, marinas and houseboat rental companies;
providing eligibility for facility relocation costs for certain district heating
and cooling nonprofit corporations to prevent interference with public light
rail projects public rights of way; creating the office of pupil transportation
safety as a section under the division of state patrol in the department of
public safety; requiring the commissioner of public transportation safety to
designate the director of pupil transportation, modifying duties and providing
for staff, report requirement to the legislature; appropriating money to the
commissioner for implementation; establishing qualifications for type III school
bus drivers; modifying certain vehicle licensing requirements; prescribing
criminal penalties; authorizing certain licensing exceptions for type III school
bus drivers under certain limited conditions; authorizing the commissioner of
transportation (DOT) to adopt rules; increasing the age requirement for motor
vehicle operators to restrain child passengers with an appropriate child
restraint system; requiring the fine to be waived under certain conditions;
removing the exemption for taxis, limousine and buses for hire; making seat belt
use violations a primary offense by authorizing peace officers to issue
citations without observing a moving violation, expanding seat belt use
requirements and providing a surcharge for traffic offenders, exceptions,
defining pickup truck and van, modifying certain seat belt exemptions;
specifying the disbursement of the surcharges by the commissioner of finance;
requiring the uniform traffic ticket to contain a notice of the criminal and
traffic surcharge; authorizing tow trucks to exceed certain length and weight
limitations under certain conditions; authorizing operation of certain
combinations with gross vehicle weight up to a certain amount on certain
highways with special three unit vehicle permit; authorizing certain trucks to
qualify for special canola hauling products vehicle permits; specifying certain
restrictions; imposing annual permit fees and appropriating the fee into the
trunk highway fund; authorizing the suspension of a drivers license for paying
or attempting to pay motor vehicle taxes or fees by means of a dishonored
personal (bad) check issued to the state or a deputy registrar; imposing
penalties for driving after suspension for failure to appear in court or pay
fines; requiring the commissioner of transportation or deputy commissioner to be
a licensed professional engineer; requiring the commissioner to prioritize for
state funding certain transportation projects in the metropolitan area awarded
federal funding through the federal surface transportation program, catastrophic
event exception; requiring the commissioner to develop and implement a transit
service needs implementation plan containing a goal of meeting certain
percentages of unmet transit service needs by certain dates, specifying plan
requirements; requiring legislative report on transit services outside the
metropolitan area and requiring metropolitan council assistance for reporting;
requiring the council to include an assessment of progress toward meeting the
American with disabilities (ADA) paratransit ridership needs identified by the
council in the program evaluation and specifying assessment coverage
requirements; requiring the commissioner and the metropolitan council to create
the required reports and assessments within current appropriation levels;
authorizing the commissioner to establish an advisory committee on nonmotorized
transportation to make recommendations on safety, education and development
programs; modifying requirements for motor carriers engaged in intrastate
commerce; modifying petition requirements for permit carriers; modifying
requirements for household goods carriers; modifying motor vehicle damage
disclosure requirements; modifying metropolitan council financial assistance
provisions relating to the replacement service program, defining off peak hours;
expanding the transit taxing district to encompass the seven county metropolitan
area, sunsetting the existing safety regulation study on bicycling; eliminating
the prohibition by the department of transportation, metropolitan council and
county regional railroad authorities to study and plan activities for the Dan
Patch commuter rail line; requiring reconstruction or improvement documentation
of the Lafayette bridge segment of highway #52 including bridge footings to
accommodate future transit (light rail transit LRT) implementation; requiring
the commissioner of transportation to issue necessary permits to the city of
Rochester to complete construction of a new interchange at marked trunk highway
52 and a local city street, assigning costs; requiring the commissioner to issue
special 2008 U.S. Women's Open special temporary permits for display on
passenger vehicle; authorizing the city of Minneapolis to restrict or prohibit
the use of an engine brake on motor vehicles along a certain segment of
legislative route #107 (I-394); authorizing the commissioner to award a road
construction project contract for a certain state project located on truck
highway #53 and certain existing intersecting and adjoining local roads, federal
aid highway funding requirement, specifying certain local approval requirements
from the governing bodies of St. Louis county and the cities of Duluth and
Hermantown; transferring jurisdiction of legislative routes #295 and #335 to the
city of St. Peter after receipt of a notice of transfer by the commissioner of
transportation (DOT); transferring a trunk highway right-of-way in Otter Tail
county to the state rail bank, providing a land parcel description; repealing
certain provisions relating to a surcharge for special veterans license plates,
for the design build award alternative process for certain contracts, certain
speed and brake provisions for implements of husbandry, the requirement for the
commissioner of public safety to adopt rules for instruction on the safety of
school children, the extensions of authority for a permit carriers approval
process, and additions to transit taxing districts

ARTICLE 2 - TRANSPORTATION
DEVELOPMENT

Modifying provisions relating to the flexible highway account,
defining excess sum; creating the metropolitan routes of regional significance
account in the state treasury for allocation to metropolitan counties to assist
in paying the costs of construction, reconstruction or maintenance of county
highways with statewide or regional significance not fully funded through other
state, federal or local funding sources; modifying certain prior transportation
provisions enacted in 2008; extending availability of the value capture study
appropriation; modifying certain requirements for the trunk highway debt service
surcharge; clarifying and modifying certain state road construction
appropriation requirements; modifying the effective date of additional motor
vehicle registration taxes; modifying the allocation of motor vehicle lease
sales tax revenue; modifying the definition of minimum guarantee county in a
joint powers agreement and modifying the effective date for metropolitan
transportation area participating county joint powers agreement prior to tax
imposition requirements; modifying certain prohibitions for county regional
railroad authorities from contributing more than a certain percentage of the
capital costs on light rail transit (LRT) or commuter rail projects and the
effective date
