E Recodifying provisions relating to driving while impaired or under the
influence of alcohol or controlled substance (DWI) ARTICLE 1 CHAPTER 169;
DRIVING WHILE IMPAIRED; CRIMINAL AND ADMINISTRATIVE SANCTIONS GENERAL PROVISIONS
The Minnesota Impaired Driving Code ; recodifying certain provisions providing
for application and restricting local ordinances; defining certain terms;
providing for the interpretation of parenthetical references; recodifying
certain provisions relating to first time violators of off-road recreational
vehicle or motorboat DWI laws; providing new provisions for sanctions for prior
behavior based on separate courses of conduct and for determining the number of
aggravating factors CRMINAL PROVISIONS Recodifying certain criminal provisions
relating to driving while impaired with new provisions describing the crimes and
providing for penalties; recodifying certain provisions providing for mandatory
penalties, long term monitoring, consecutive sentences, stay of execution of
sentences, chemical dependency assessment charges, penalty assessments, alcohol
related school or head start bus driving, underage drinking and driving and the
open bottle law PROCEDURAL PROVISIONSRecodifying certain provisions providing
for arrest for driving while impaired or for alcohol related school or head
start bus driving offenses, preliminary screening tests, impoundment of motor
vehicles under local ordinances, the responsibility for prosecution. conditional
release, evidence, affirmative defenses, notice of enhanced penalty and immunity
from liability ADMINISTRATIVE PROVISIONS The Implied Consent Law ; recodifying
certain provisions relating to chemical tests for intoxication, test refusal or
failure, administrative and judicial review of license revocation, impaired
driving convictions and adjudications, administrative penalties with new
provisions providing for underage drinking and driving and alcohol related
school bus driving violations, license revocation termination and reinstatement,
administrative impoundment of license plates and vehicle forfeiture for
designated offenses or license revocation MISCELLANEOUS PROVISIONS Recodifying
certain provisions providing for alcohol safety, research, driver education and
remote electronic alcohol monitoring programs, chemical use assessments, pilot
programs of intensive probation for repeat impaired driving offenders, impaired
driving rules, civil actions and punitive damages ARTICLE 2 - CONFORMING
AMENDMENTS; IMPLEMENTATION OF ACTExtending the ignition interlock device pilot
program for persons convicted of driving while under the influence of alcohol or
controlled substance (DWI) and exempting the department of public safety from
rulemaking requirements relating to the pilot program, specifying certain device
design requirements, requiring manufacturers submitting devices for
certification to provide an application for certification on a form prescribed
by the department, modifying certain conditions for the issuance of limited
drivers licenses; making conforming amendments to certain statutory provisions
relating to juvenile court records and jurisdiction, crimes punishable under
different provisions and maximum bail on misdemeanors and gross misdemeanors
with modifications in the number of years for consideration of certain prior
violations; establishing a driving while impaired felony working group,
specifying membership requirements and requiring the group to study and make
recommendations on the implementation of felony level impaired driving penalties
and to study methods used by other states to address repeat impaired driving
offenders, requiring a report to the legislature by a certain date; requiring
the commissioner of corrections in consultation with the commissioner of human
services to develop a correctional plan to respond to the recommendations
submitted by the working group, specifying certain plan requirements and
requiring a report to the legislature by a certain date; specifying certain
reference change, cross reference correction and publication instructions to the
revisor of statutes; repealing certain existing provisions regulating DWI
