E Relating to the classification and dissemination of government data ARTICLE 1
� GOVERNMENT DATARequiring the court to award reasonable attorney fees to
prevailing +plaintiffs bringing civil actions against government entities to
compel +compliance with written opinions issued by the commissioner of
administration under +the government data practices act; defining electronic
access data and +cookie for classification purposes, classifying and regulating
the use of the +data; classifying and regulating access to certain educational
data on +nonpublic school students collected by public schools; clarifying the
provision+ requiring schools to report alleged involvement by students in
dangerous +weapons offenses on school property to the juvenile justice system;
classifying and +regulating access to certain university of Minnesota claims
experience data +relating to group health, dental, life, disability or workers
compensation +insurance; classifying national night out event locations for
community crime +prevention programs participation purposes as public data;
classifying and +regulating access to data submitted by government employees as
part of +organized self evaluation efforts by government agencies to obtain
suggestions from +employees relating to cost reduction and efficiency;
authorizing the sharing of+ county mental health data with police department
crisis intervention teams +to determine the client status of apprehended
persons; providing for the+ sharing among county welfare, human services,
corrections, public health and +veterans service agencies of certain data on
individuals without consent of +the subject of the data; classifying data
received by the department of +agriculture from the federal department of health
and human services, the food and +drug administration (FDA) and the agriculture,
food safety and inspection +service to carry out statutory food safety
regulatory and enforcement duties and+ data on individuals given to the lottery
for direct marketing purposes; +clarifying the classification of information in
bids and proposals under state +procurement provisions; requiring release of
birth records to county local +welfare agencies for certain newborns abuse
protection purposes; authorizing +dissemination of certain wage detail data to
out of state agencies designated as +performance accountability and consumer
information agencies to carry out the +requirements of the federal workforce
investment act of 1998 without the consent +of the subject of the data for
unemployment insurance purposes, authorizing +the commissioner of economic
security to enter into data exchange +agreements with employment and training
service providers with the consent of the +subject of the data for services
evaluation purposes; classifying certain burial+ site data maintained by the
office of the state archaeologist; requiring the +common entry point for
vulnerable adult abuse reports to notify local medical +examiners about
suspicious deaths ARTICLE 2 � FINANCIAL PRIVACYProviding consumers a right to
privacy, confidentiality and secrecy +of financial records for consumer
protection purposes; requiring +financial institutions to comply with certain
provisions of the federal Gramm-Leach-Bliley financial services modernization
act and +prohibiting disclosure of nonpublic personal information on consumers
to +nonaffiliated third parties, exceptions; providing for the use and form of
+affirmative consent, prohibiting use as a required condition of doing business
+with financial institutions; providing for access to and correction of
+nonpublic personal information under certain conditions, authorizing financial
institutions to charge a reasonable copying fee; authorizing attorney+ general
remedies for violations; specifying the relationship of the +requirements and
restrictions to other lawARTICLE 3 � INTERNET PRIVACYClarifying certain
provisions regulating data on Internet consumers +maintained by Internet service
providers; excluding certain nonidentifying information from the definition of
personally identifiable +information; requiring reasonable authentication of
consumer identity before +provider disclosure of personally identifiable
information to subjects of the information and requiring provider disclosure of
the information +required by a certain federal law; providers not to be required
to create or +retrieve information in formats not maintained by the provider at
the time of +request for disclosure or to establish or maintain a system for
