E Relating to state government ARTICLE 1 � DEPARTMENT OF ADMINISTRATION
Modifying certain department of administration provisions; updating +the
reference to a certain federal law relating to certain developmental
disabilities responsibilities; removing the Duluth government service+ center
from the responsibility of the commissioner to operate and maintain +certain
buildings; increasing the threshold for projects requiring designer +selection
board approval; modifying certain language under the state building +code
relating to municipal agreements with the commissioner for code +administration
and enforcement, authorizing the commissioner to direct the state +building
official to assist communities affected by natural disasters with +building
evaluation and other building code related activities; modifying the +authority
of cities to extend code enforcement to contiguous unincorporated +territories
and defining enforcement for purposes of enforcing the code in +extended areas;
requiring the commissioner to annually report on professional or +technical
services contracts awarded without following the solicitation +process;
temporarily authorizing and providing for the commissioner to enter +into
guaranteed savings contracts for the evaluation, recommendation and installation
of utility cost savings measures under certain +conditions, defining utility
cost savings measure and certain other terms; +authorizing lease purchase
contracts for implementation of the measures under +certain engineering report
recommendations conditions, specifying a duration +limit; providing for affected
state agency use of capital cost avoidance for+ the savings contracts; requiring
commissioner biennial reports to the +commissioner of finance and the
legislature on projects funded through guaranteed +energy savings; changing
references from sheltered workshops to extended +employment providers under
certain state procurement provisions; modifying the +definition of building
standards for statutory warranty purposes; repealing a +certain reporting
requirement of the commissioner relating to state +procurement ARTICLE 2 �
DATA PRACTICESAuthorizing the commissioner of administration upon request of
+government bodies subject to the open meeting law to issue written opinions
+relating to duties under or compliance with the law, requiring payment of a
fee, +exempting the bodies or members from liability for certain fines, fees or
+penalties under the open meeting law and from subjection to forfeiture of
+office for acting in reliance on the opinion; requiring the court to award
+reasonable attorney fees to prevailing plaintiffs bringing civil actions
against government entities to compel compliance with written opinions issued+
by the commissioner under the government data practices act; defining
+electronic access data and cookie for data classification purposes, classifying
+and regulating use of the data; classifying and regulating access to +certain
educational data on nonpublic school students collected by public +schools;
classifying certain university of Minnesota claims experience data +relating to
group health, dental, life, disability or workers compensation +insurance;
classifying national night out event locations for community crime +prevention
programs participation purposes as public data; expanding the +definition to
personnel data to data submitted by employees to government entities +in self
evaluation efforts relating to cutting costs and operations +efficiency or
improvement and regulating access; providing for the sharing among +county
welfare, human services, corrections, public health and veterans +service
agencies of certain data on individuals without consent of the +subject of the
data; classifying data received by the department of agriculture from+ the
federal government to carry out statutory food safety regulatory and enforcement
duties;classifying data on individuals requesting electronic transmissions +from
the state lottery; clarifying the classification of information in bids +and
proposals under state procurement provisions; classifying and +regulating access
to military discharge certificates; authorizing dissemination of +certain wage
detail data to out of state agencies designated as performance +accountability
and consumer information agencies to carry out the requirements of +the federal
workforce investment act of 1998 without the consent of the subject +of the data
for unemployment insurance purposes, authorizing the commissioner of +economic
security to enter into data exchange agreements with employment and +training
service providers with the consent of the subject of the data for +services
evaluation purposes; classifying certain burial site data maintained +by the
office of the state archaeologist and data on individuals given to +the lottery
for direct marketing purposes; repealing a certain annual reporting +requirement
of the commissioner of administration relating to progress toward +certain
procurement objectives and goals and a certain provision relating to +access to
certain tax data (ra, ja)
