3E Relating to state mandates

ARTICLE 1 - EDUCATION

Removing and
simplifying certain primary (pre-K-12) education mandates,
removing certain
information requirements for state reporting, modifying certain notice to county
attorneys, the teacher preparation time requirement, staff development revenue,
permitting revenue and expenditure budget summary publication, increasing the
maximum expenditure amounts for commissioner of education consultation
requirement for construction or remodeling and review and comment, removing the
charter school length of school year requirement, increasing the population
qualification requirement for community education director hiring, clarifying
special education assistive technology device, repealing compulsory attendance
fact-finding and mediation, board adopted days of instruction, student
evaluations to board, district periodic report, biennial
evaluation of
assessment program, uniform forms for state examinations, reports of dangerous
weapon incidents in school zones, requirements for assessment professionals,
schools mentoring schools regional sites, the administrators academy and
transportation aid entitlement district reports

ARTICLE 2 - HUMAN
SERVICES

Exempting certain group residential facilities licensed by
commissioner of human services from department of health food, beverage and
lodging establishment regulations; modifying department of human services day
treatment time block requirements and removing the requirement for children's
day treatment services inclusion as an integrated set of education, therapy and
family interventions and removing an availability requirement; modifying the
time period requirement for emergency admission level of care determination for
inpatient residential treatment screening; requiring county payment for
Minnesota family investment
program (MFIP) and public assistance recipients
cremation under certain
conditions; removing a medical assistance (MA)
requirement for provider entity certification for noncounty entities; clarifying
the MA provider entity review and update requirement; removing certain mental
health practitioner MA reimbursement requirements; modifying MA children's
therapeutic service delivery criteria for day treatment programs; eliminating
the requirement for family services collaborative to continue base level of
expenditures for families and children from other states, federal, county or
other funding sources; modifying the child protection caseworker definition;
removing the requirement for commissioner to revise certain rules relating to
family and group foster care and requiring commissioner of human services (DHS)
to relieve foster care providers of certain requirements

ARTICLE 3 - HEALTH
CARE

Requiring commissioner of health to accept independent audits; modifying
nursing homes requirements for incontinent residents and specifying regulations
for changing positions of nursing home residents unable to change positions and
allowing comprehensive assessment and care plan governance; defining medication
reminder; modifying standards for supervision of home care services; providing
for home health aide qualifications; providing for day training and habilitation
or supported employment services programs, providing for programs with
three-year accreditation, providing for investigations of alleged maltreatment
of minors or vulnerable adults, requiring commissioner to submit a request to
commission of rehabilitation facilities to expand accreditation
survey;
modifying health care student information provided by school districts
and
charter schools and human services department health care programs outreach
renewal notice requirements; allowing municipalities to provide employee and
dependent health benefits through negotiated contributions to self-funded
multiemployer health and welfare funds

ARTICLE 4 - PUBLIC SAFETY

Removing
from felony level criminal presentence investigations a reporting requirement
for controlled substance adverse social and economic effects on
neighborhoods

ARTICLE 5 - LOCAL GOVERNMENT

Authorizing local government
units (town, county, city) to submit group
applications for administrative rule
or state procedural law waiver or temporary exemption; providing a procedure for
rules requiring local implementation and effective date determination; requiring
parties to agree to costs for ballot questions and exempting office of
administrative hearings from costs; authorizing use of credit or debit cards for
motor vehicle registration renewal and transaction fees and allowing collection
of a surcharge; increasing minimum amount for municipal construction codes and
licensing cumulative fees reporting for certain years; allowing towns to require
bonds for persons employing fence viewers; authorizing towns to prohibit further
burials in an abandoned cemetery; increasing county boards small claims minimum
amounts for publication requirement; removing appeal to district court for
county officers; modifying and removing provisions limiting the practice of law
by deputy sheriffs and coroners modifying county auditor, treasurer, recorder
and sheriff salary guidelines, uniform municipal contracting law and
construction bid guidelines and applicability; modifying a local government
policy requirement for out-of-state travel record development and review;
updating metropolitan government comprehensive plan requirements to include
Anoka and Dakota counties; requiring records retention task force of Minnesota
clerks and finance officers association in conjunction with Minnesota historical
society to conduct a study to review permanent retention schedules applicable to
local body records; repealing regional counties facilities groups, county
auditor minimum salary requirements, county treasurer salary schedule, county
recorder and abstracter and sheriff maximum and minimum salaries
requirement

ARTICLE 6 - TAXES

Abolishing property tax levy limits;
eliminating truth-in-taxation hearing
requirements and temporarily suspending
advertising requirements; requiring taxing authorities to announce the time and
place of scheduled meetings at which budget and levies will be discussed and at
which the public may speak and requiring newspaper publication; modifying
certain school board notification requirements for expenditure budgets;
modifying publication correction requirements; increasing the property tax
amount for unpaid real estate taxes installment payments; modifying local
government commissioner of revenue reporting requirements, repealing certain
joint public hearing requirements
