hf2688FIFTH ENGROSSMENTOmnibus crime prevention and judiciary finance
bill.ARTICLE 1 APPROPRIATIONSSection 1: criminal justice appropriations
provided. Sec. 2: department of corrections appropriations provided. Sec. 3:
public safety appropriations provided for criminal justice technology, and
criminal apprehension positions, including interface with the national sex
offender registry. Sec. 4: sentencing guidelines commission appropriated money
for a pilot project in Ramsey county to ensure uniform charging on criminal
complaints. Sec. 5: supreme court appropriation provided to redevelop court
information system used by counties.ARTICLE 2 PREDATORY OFFENDER REGISTRATION
AND COMMUNITY NOTIFICATION PROVISIONS Sec. 1: predatory offenders registration
expanded to include violations pursuant to court martial; and persons entering
the state to reside, work or attend school; and persons committing similar
violations of another states law or of United States law. Sec. 2: information
made public concerning persons who fail to register. Sec. 3: registration
requirements provided for persons attending school, and for persons working or
attending school outside the state; requiring registration in the state where
the person works or attends school. Sec. 4: registration contents expanded to
include history of admission or residence in a treatment facility, documentation
of treatment received, and verification of address form requirements specified.
Sec. 5: predatory offender registration requirements provided, including
residences, property, locations of employment, and vehicle information. Sec. 6:
felony criminal penalty provided for violating registration provisions. Sec. 7:
duration of registration clarified relating to new offenses or violations, and
lifetime registration required for specified offenders. Sec. 8: registration
data classified as private and use limited to law enforcement, and exceptions
provided. Sec. 9: information on offenders who are out of compliance with
registration law made available to public. Sec. 10: registration application
defined. Sec. 11: crime against the person defined, and registration
requirements applied retroactively to previous offenders. Sec. 12: replacing sex
offender with predatory offender, commissioner of corrections informed of
information disclosure to the public, and website created and maintained with
level III offenders information. Sec. 13: clarification provided regarding
notice on information regarding predatory offenders. Sec. 14: predatory
offenders database created and maintained by bureau of criminal apprehension.
Sec. 15: criminal justice funding report required. Sec. 16: effective
dates.ARTICLE 3 NAME CHANGE PROVISIONS Sec. 1: name change application denial
specified. Sec. 2: criminal penalties provided for convicted felons who use
different surname upon marriage. Sec. 3: convicted felon name change procedure
specified. Sec. 4-5: marriage license application felony information
requirements specified. Sec. 6: marriage dissolution decree name change
provisions clarified. Sec. 7: effective date.ARTICLE 4 CRIMINAL AND EXPUNGEMENT
PROVISIONS Sec. 1: criminal sexual conduct offenses treatment authorized as
crimes punishable under different provisions. Sec. 2: criminal sexual conduct in
the first degree mandatory minimum sentence imposed. Sec. 3: definition of
solicit expanded to include conduct by telephone, letter, or electronic means.
Sec. 4: felony penalties provided for soliciting someone the person reasonable
believes is a child. Sec. 5: criminal sexual conduct and soliciting of children
offenses prosecution allowed in any jurisdiction in which violation originates
or terminates. Sec. 6-7: harassment crime definition extended to delivery of
electronic messages. Sec. 8: expunged records or DNA samples not to be returned
to subject of record, notice of expungment orders to other jurisdictions
required, and automatic stay of expungement orders provided. Sec. 9: statute of
limitations removed for crimes resulting in death, for kidnapping, and for
criminal sexual conduct offenses where physical DNA evidence is collected. Sec.
10: effective dates.ARTICLE 5 CRIMINAL JUSTICE INFORMATION TECHNOLOGY AND
INTEGRATION Sec. 1: criminal and juvenile justice information policy group
membership increased to include commissioner of administration, commissioner of
finance, and four members of the judicial branch. Sec. 2: policy group reports
required annually. Sec. 3: criminal and juvenile justice information policy
group grant local match requirements modified. Sec. 4: criminal justice
technology infrastructure improvement provided. Sec. 5: criminal justice policy
and funding reports required on technology infrastructure improvement grants,
court information system, and Ramsey county pilot project. Sec. 6: proposed
effectiveness measurement standards and sanctions developed and report required.
Sec. 7: effective date.ARTICLE 6 DATA PRACTICES PROVISIONS Sec.1-2: agencies
allowed to disclose address data to law enforcement officers of persons required
to register as predatory offenders but not living at registered address, and law
enforcement provided access to data maintained. Sec. 3: law enforcement allowed
access to workers compensation addresses of persons registered as predatory
offenders but living at different addresses. cth
