A bill for an act
relating to public safety; limiting the circumstances under which a "no knock"
search or arrest may be conducted; proposing coding for new law in Minnesota
Statutes, chapter 626.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) Except as provided in paragraph (b), when executing a search or arrest warrant,
before entry, a peace officer shall give notice of the authority and purpose of the entry.

new text begin (b) A warrant may dispense with the notice and purpose requirement of paragraph
(a) only if the case involves a crime of violence and the warrant affidavit sets forth exigent
circumstances with sufficient particularity disclosing facts that are reliably documented
and furnishing the court with a substantive basis for believing that there is an imminent
peril of bodily harm or threat to public safety.
